MAINTENANCE PROBLEM

What can shareholders in a small co-op do when one of the shareholders is overdue with maintenance and does not reply to phone calls or email and has not been seen in the building? Does anyone know what  some options are?

Yes, it sounds like an eviction proceeding is in the future for your co-op, and most proprietary leases are written in such a way as to make that process pretty expedient.  However, you will need a good lawyer who has been through it before to make sure that it’s “bullet-proof” later.

On the other hand, something else may be going on.  A few years ago, new shareholders in our co-op were killed in an automobile accident overseas.  So tragic, and it took us a few months to realize what was happening and contact their family members.  Do you have emergency contact info. for these shareholders?

Excatly, have the lawyer send a notice to cure and then file for eviction. That usually clears things up.
