Who does the deed transfer to after death?

If a property only has one person’s name on the deed. What exactly happens to the property if the person becomes deceased? Does the property become split with his living family members or does it transfer over to the city?

It’ll enter probate, with  or without a will to determine who gets the home (or it’s value)  – if equal parties of inheritance will not agree to accept the home – there is a period of time they will be given to sell the home, and it’s value split between the parties.

Such a transfer is either governed by a will (and anyone owning a house should have one) or governed by the laws of the state regarding people dying “intestate” (i.e. without a will), which look at the degree of relationship between the deceased and the family members.  It would be a rare situation indeed when there were no relatives to inherit and the city might have a claim.  Talk to a Wills and Estate lawyer.
