No one believes you have presented evidence of underpinning or any other work next door that would have required a permit or that would have damaged your house. Noises is not by itself evidence they did something wrong. The picture you posted seems to be of a small area of a door frame, though it isn’t clear.

When I referenced the outrageous loud noise for 2 weeks to a structural engineer – he said it was underpinning. When I said underpinning to a lawyer – he said demolition. If I called both times – perhaps it would have stopped both illegal projects.

By the way, on Saturday night, he was drilling on my walls and then vacuuming. On Sunday morning – he was drilling upstairs.

There is no way an engineer can know if someone is doing underpinning based on a loud noise. Also there is nothing illegal or unjust about drilling and vacuuming on his side of the party wall.

I heard him scrape against walls and then vacuum it up – had to have been my walls. In order to access my walls – he would have had done something to the party wall. Either remove it or alter it. 2 illegal jobs that I did not report.

LOL I can hear my neighbor nailing stuff into his wall sometimes and we have a TON of insulation and a brand new party wall (we had to re-mortar the entire thing.) You probably just have virtually no insulation. If they are rebuilding the drywall on the other side, they’ll probably add insulation and then you’ll hear even less!

I really believe my walls are reduced to not much on his side of the wall. And the 2 weeks was to damage my property – I see cracks. I’m sorry I never reported the jobs and I’m sorry I didn’t sell the house in 2016.

If he is doing work on your party wall (like repointing it) I can certainly see how it might cause cracks in your plaster. The contractor should take care of it but that does NOT mean they are underpinning necessarily. When they are done, it is likely that you will have a stronger wall then you did before- they have absolutely no reason to want to intentionally cause problems with your party wall, all that will do is give you a reason to sue them.

Also, you must realize that most party walls are one-brick thick. So there’s no way for him to “reduce [it] to not much on his side” except to remove drywall or plaster or whatever, which should not effect the structural integrity of the wall.

Answer the sell the house question. So on 12/5 there was a huge noise for 20-30 minutes coming from his apartment – adjacent to mine. That is when he talked the party wall. Then for roughly 1 month – drilled away at the walls reducing them to very little. That is my thesis.
