    Bxgirl, the question will be how the courts are willing to define ‘uninhabitable.’ If the plaintiff in that case is seriously bothered health wise (say allergic to cig smoke) then it could be deemed uninhabitable for that person.

  2. The better hotels in Thailand WILL NOT allow you to bring Durian in. They will allow you to bring in go go girls and boys but some frown upon it.

    The lease for my tenants says “No Smoking Allowed.”

  3. Snappy, won’t it ultimately come down to a question of uninhabitable vs can’t stand the smell?

    Personally I think developers should install better systems- although, considering the , er…cleansing system of the Corcoran condo, one wonders how good they would be.

    I know smokers- my mother was a heavy smoker until long after I went to college. I hated it. But my objection to telling people how to live inside their own apartment becomes a question of privacy and equal rights. DO you want the government telling you how to fluff your pillows or when to dust lest your neighbor be allergic? What about people who are allergic to perfume? Should women not be allowed to use any if the neighbor can small it? Work places, public places- fine. No smoking. Hotels- absolutely. But how far are we willing to go? Me? Not to the extent of giving up my privacy rights. (DH- did I tell you pink is my favorite color? 🙂

  4. When I’m sitting on my sofa, I can sometimes smell cigarette smoke from my neighbor. It’s nauseating.

    When I’m in bed, I can sometimes hear my neighbors on the other side of me getting their freak on. It’s nauseating.

  5. if youre going to ban indoor smoking you will also need to ban indoor farting. the number one cause of the holes in the ozones are gases emitted from flatulence! gross

    i lived once where i used to smoke in the courtyard because i wasnt allowed to smoke in the apt, then after a while this woman would make a phoney cough and slam the windows shut. had she just asked me to not smoke in the damn courtyard i would have gladly gone outside, but she was really passive aggressive about it, and this went on for months until i finally was like okay this woman is nuts so i just went outside to not bother her. if i lived in an apartment and the smoke was going into someones apartment and they asked me not to smoke inside, id probably just start smoking outside again. we just got new neighbors on the side and the top of us, with bay-bays and animals and one is the owner of the building!! so im totally imagining this scenario happening, but the walls seem pretty solid. the only people who really do seem to complain about people living in flimsy housing and/or neighbors who are oddly allergic to EVERYTHING.
