The Daily News had an article on a group of tenants who live in 294 Fifth Avenue in the Slope and say conditions in the rent-controlled building have deteriorated since the property went into foreclosure a couple years ago and a receiver was appointed to take care of it. The building’s boiler, for example, didn’t work for three weeks this winter, and the front-door lock is broken. Public Advocate Bill de Blasio held a news conference yesterday to support the tenants in seeking a court order that would force the receiver to make repairs. According to the article: “The slumlike conditions at 294 Fifth Ave. spotlight a growing concern: smaller apartment buildings that fall into disrepair in part because the building is overleveraged. ‘We think this is a growing problem around the city that the banks and lenders are not taking responsibility for,’ said de Blasio.”

    This tenant is no wallflower – the building has 99 violations (check HPD website – DOB is not where you look) almost all attributable to her complaints and almost all are middling complaints that an HPD inspector could find in almost any building in NYC or were likely directly caused by the tenant herself (bars on the windows, illegal dropped ceiling etc….). This is the type of tenant that cause HPD on a daily basis to complain about everything…..big and small. But a check of these violations do not show a “slum” or anything like that….Additionally (and proof that this tenant is a ‘complainer’ the building next door owned by the SAME LLs has 16 violations the most recent 2007 (for a burned out entrance light) – the one prior…1990 for flowerpots on the fire escape…..

    I think there’s enough evidence here that this person and her $149 a month rent is a pretty good example of the worst of the worst. I wander what her son, Angel, has learned from her.

    We hardly stay in hidden recesses. How considering MM’s columns and posts are a daily event, that has got to be one of the funnier things you’ve ever said. Not logical, but funny.

  5. bedstuy11216…you would think so but I bet it’s fraught with all sorts of legal issues and mountains of beauracracy and red tape, like everything is these days.

So whats my conclusion….what I always thought – Bill Diblasio is a total hack – down to his fake name – he found a tenant that would let him make a spectacle in a very convenient location to Bill Diblasio’s house (and favorite coffee shop). If Bill Diblasio cared about slumlords, tenants or anything beyond his next campaign, he’d have gotten off his fat ass and found one of the MANY slums in this city and tried to do something more than having a press conference.
    Therefore, I suggest people look at this story for what it is….a pathetic political show…rather than trying to fit in something that doesn’t necessarily fit, like a rich entitled person taking advantage of RC laws or slumlord abusing the poor. [there will be a thread soon enough for that fight]

I think some of this vitriol is misplaced here, while I have no doubt that the tenant in question is hardly a non-complaining wallflower, the fact that she pays $149 a month is somewhat irrelevant – this obscenely low rent is far more the fault of current and past LLs and the law than some women unfairly taking advantage of the system – look she has lived there for 40 years and that IS THE LAW. I have no issue AT ALL with anyone following the law. If the lawful rent is $149 than so be it, good for her and the LL has no excuse for not maintaining the property
    – btw I would be equally strident in backing up the landlord if he came in and did every building-wide improvement he could and therefore the tenants rent would increase 6% a year (maximum allowed) for the next 10 years

    Its the law and everyone is entitled to follow it.

    That being said…..
