Thanks, Cate, this is a good suggestion. I asked the LL to ventilate but they said they cannot open windows if rain or snow.. Next step is to file a complaint with dept of health.

You could also ask your landlord to use water-based polyurethane, not oil-based. It works fine and each coat cures more quickly than oil based, so reducing the time fumes are around. It is more expensive (at least the good stuff is) but if the landlord is paying for the labor, that should go much quicker. At a co-op in Queens where I used to own, they would not permit oil-based poly, although I think their concern was more the fire hazard of the rags than the fumes entering neighboring spaces.

move.. buy your own place.. then you can use whatever organic, cage free, vegan type of paint and polyurethane you want. you’re exaggerating. i use moisture cure all the time and it’s the smelliest stuff i know of and it lasts no more than 24 hours. i doubt your LL is doing anything illegal.

High VOC paints and adhesives are rapidly being phased out or already illegal in NY State and several neighboring states. It has been in progress several years now. (Volatile Organic Compounds, like in oil based paint) I don’t know what your landlord is doing, or if low or none VOC products are available/required. I am using newer paints and I am pleased with the results, but some of them dry on the brush too quickly. I liked the old-school oil paints, but they were toxic. You can investigate this easily. Copy the label of an empty can your landlord’s painters have discarded and search on that product on the internet. (Don’t stick your nose in it, and wear gloves if it is wet) Take that information to a store that sells paint, or call customer service at a paint company, and explain it all to them. Paint company customer service reps are very careful now what they recommend. They seem to understand the legal exposure. If their is a lower-toxic alternative, you can find out all about it. You don’t have to have studied chemistry, but it helps.

You are unlikely to have any legal remedy–the materials are approved for use in the United States (presumably), so no grounds upon which to make the management company use something else. Are you an owner or a renter? Is there a coop board? Making the management company aware of the concerns, with a request they use a different poly (provide a list of green options, if they exist) is your best bet to remedy. I know, old fashioned “talk to the person about your concerns” approach. Works great in my experience. Good luck.

Building Management is using strong smelling poly to redo floors in units at least once per month. Fumes penetrate other apartments for at least 5-7 days afterwards. This seems to be hazardous in my opinion. Outside of complaining to 311, what other action can tenants take?
