Contractor is bankrupt

Can I get a another one to finish his work which is 95% done and have them close out his permits. I would also hire this new contractor to renovate the last apartment. I really feel screwed by the current contractor

I have also been through this. If you can get the subs to continue on the job that is key as the plumbing, electrical and HVAC permits are actually in there names. Subs do hate taking responsibility for another company’s work so if they won’t come back you will have to find other sub contractors to take over their permits. Actually taking over the permit is easy to do at DOB. Another factor to consider is if any inspections have been done. That can get tricky especially if you are changing sub contractors. Yes you can. I did it and did not have to file anything as no permit was pulled. Here was the scenario, the contractor “walked away” (he claimed he was losing money and so started making claims why things were extra etc.). It was not the case and I made it clear to him, after he refused to comeback I simply carried on. I contacted the plumbing and electrical subcontractors and the architect and told tem that the contractor had left and asked them if they wanted to continue, etc.(the plumber said he was oweed $3k and I aked him for proof and I paid him). The architect also cooperated. Once the work was ‘done’ I (owner) went to DOB and requested a final inspection. They came, twice (after pointing out some things that needed to be done) and after the architect did the final filing we got the COC (certificate of completion). the architects cooperation was key – and the fact that the contractor did not pull the permit (he would have been sorry if he had) – he owes me money but going to arbitration, confirming a judgement (with slim to none chance of recovery) is not worth it. Nor would it be in your case. If a permit was filed just go to the NYDOB website type your address and look for the ‘job file’ it will tell you which documents are required and which are missing, etc. it might be a simple matter remaining (such as the final inspection or survey – I had to hire a surveyor and also the testing lab for a ‘perculation test’ – all without the need for the Contractor). By the way, at the time of the dispute with the contractor I contacted an electrical contractor (who did work for neighbors ) and me a full “song and dance” about taking responsibility for someone else’s work – ‘can really touch it unless I spens a lot of time going everything). All BS as it is not that complicated – previous contractor also licensed and roughing inspection already done etc. – all that is an excuse to scare you to pay lots of money – Simple electical/plumbing circuits and panels and the DOB inpector (and/or trough architect) will catch the ‘safety’matters. So I thanked him and hung-up the phone. He called me right back because he thought we got disconnected – “no, I will move on’ was my response…’ There are still decent architects, and contractors for whom continued business and goodwill (rather than gouging) are important. yes, you will need to file a that the new contractor is taking over the permit and taking responsibility for the work. are you continuing with the sub contractors?
