Looking for an architect with the following experience. I would like to remove fire escape from parlor floor of a 3 family house and add a steel porch with stairs off the parlor floor. I want add drop down ladder from the second floor fire escape (the floor above the parlor) MDL 53 says 15 foot drop down ladder is suffient. Is this an Alt 1 or Alt 2 permit?

16 feet from fire escape to ground not 15 feet.
b. The distance from the lowest balcony to the ground or safe landing place beneath shall be not more than sixteen feet, except that the department may permit such lowest balcony to be up to eighteen feet above a public sidewalk because of structural conditions in any multiple dwelling erected before April eighteenth, nineteen hundred twenty-nine.

It’s quite unlikely you’ll get this past any plan examiner at the DoB. While the MDL allows it, that’s not the governing code, which in the case of removing and creating an egress path would be governed by the Construction Code, not MDL. The most recent code would govern, so you’d be conforming to 2014 code. Modern code doesn’t allow ladders as egress.
Furthermore, in terms of the DoB’s culture, you will find resistance there to any application removing a fire escape, period.
Good luck, but I think you will find the path you outline quite difficult to get approved.

Smokeychimp is right about the DOB examiners not welcoming a path for you to remove a FE. 3-Fam C of O’s make filing a parlor fl deck financially outrageous. Try also looking up the survey on your address and if it is not poorly written you may find it helpful.

I contacted this company http://kkmironworks.com they had a photo of multilevel porch fire escape combo. There must be a way to have a porch that doubles as a fire escape legally.
