You would need to change the C of O. Technically, the use is non-conforming in its current configuration.

I’m looking at buying a place in Crown Heights that’s designated as a two-family – configuration on the C of O is a triplex (basement/1st/2d floors) and a top-floor unit (3d floor). It’s being used as a basement rental with a triplex above, and I’d like to keep that configuration. The basement is completely above-grade and appears (to my non-engineer eye) to conform to code re light, egress, etc. Would I need to change the C of O to conform to the current use if I wanted to keep using it this way? If I try to pull a permit for work in the future, will this be an issue for an inspector? Interested in answers from a legal and “what people actually do” perspective.
