Tenant wants lead testing.

Y ou mean testing?
for an obvious rea sons I could not recommend the comany who did that testing for us. The guy who did he testing did a good job reading and collecting tests.
But the the sloppiness with sen ding results and how they dealt w it h our questions – I w ould not recommend them.

Why’s mess! Reading this post makes me very happy that O bought my house long ago, when single family brownstones in Lefferts Manor were very undervalued, and O never had to be a landlord. Sometimes it’s good to be OLD!

No. Jeremy is correct. You want control. Call that guy lluke oe the guy dennis. Talk to the guy dennis. I hammered him with questions and he was nice.

Also, if the tenant is sincere and just wants this fixed and wants to get back into that space, that could be good.

And my response is get a pro to guide you. Look, we are all guessing. Call an inspector. Even if it costs you 1k. Also, if the city gets involved you might end up needing one for a wipe test, so call luke or dennis and ask them how much to visit and give you an on site consultation and if you use them for follow up wipe tests, ask if they can work the cost of the consultation into that.

This guy i spoke to was nice. I called back a second time and he was calm. Call him. You might sleep better.

It is hard. We never ignore our tenants, do beyond reasonable, sometimes regret that we are too responsive then do it again.
Thought about selling the house, but I am so attached to this house, ideas, money, emotions poured in this house, still some plans to complete.
Obviously being too responsive – some tenants take advantage. But not all of them.

Luke’s great. His dust samples and remediation advice was sufficient for the city in our instance. He is strongly recommended on park slope parents, which your tenants are inevitably a member of, so his views should give them comfort.

I believe it is soil that triggered my sons elevated levels.

And i want to say sadley, those people are correct about the legal liabilities. Managing them. So while you have to try to maintain some control with the city and maybe getting in front of this, the legal liabilities are another matter. After some of what i read, i agree with them and if i were you i would go to an attorney who specializes in this and ask for a paid consultation. A sit down. No free over the phone.

About that report you are getting, you are using your inspector and paying them for the report and if it were me i would not share it with anyone until ordered or if your attorney thinks it might help, say if some minor situation is found and corrected.

I hope you did not begin cleaning because you want this guy to find lead in the dust on a surface by a door or window. You want to be able to pinpoint a spot and say that is it and we will address that spot. If the inspector cannot find the source – and i already mentioned that the city’s investigator will check foods, utensils, travel, near by construction – the city will continue to put you under scrutiny and if they cannot find it, it will get worse. And by the way, i definitely would not try to clean something in order to decieve because the way it sounds is if you do not do things the way they want, it will work against you. Bringing in the wrong people will also work against you. While you might not want to volunteer your report to anyone, you do not want to do anything that could make you look deceptive or as though you would knowingly do the wrong thing. Don’t give them ammo.

I hope you canceled that other contractor. You want the lead inspector to see this place as it is with lead dust where it is.

What is your thought on X-ray testing? I am afraid that x-ray will detect some lead covered by new paint and our tenant will freak out even if it is not posing any danger because it is covered by several layers of new paint.
Also, I read the research that capillary lead test ( prick from baby finger) could be used only as a initial screening tool.
It is more then 55% false-positive comparing to the vein test performed the same day.

Also, even vein test is not accurate on such low numbers. It makes sense only above 5.
2 means that it is really zero or 4.
Tenants said that pediatrician told them that they have to do vein test but first they want to test the apartment…

Combining with the fact that lead is 100% present in all old buildings and even if I believe it is safely encapsulated in ours, x-ray stil l could find it.

We do have attorney at that point, it is more my loud thoughts in this thread…

Since 3 family, I believe you have 364 days to test with XRF from date you officially learn the kid moved in (i.e. lease start date, written notification from tenant that baby came home from hospital, etc). If tenant is being rude or uncooperative and you suspect may be litigious, then you might be better off limiting to surface samples for now, and do XRF test later. I would defer to a compliance specialist about this instead of counting on this board’s advice to be up to date and accurate
