It is not necessarily illegal to have an AIR BnB in your primary residence, there appears to be a distinction carved out for short term rentals of private rooms in that a private room rented for less than 30 days is legal only where a permanent resident was present during the stay. Here is a link to AG Schneiderman’s 2014 study on Air BnB….

Right, I think we all understand that. You can rent out a room in your apartment where you live while you live there. the discussion here is about the legality of renting out a vacant apartment in a house you own short-term through airbnb. For that, as many hve pointed out, the alw seems to be that your c/o needs to expressly allow that use.

The AG report focuses on the rental of an “entire/home apartment” for less than 30 days. If you restricted/closed off certain portions of the apartment, wouldn’t that circumvent the ‘violation’. For example, my units are 1.5 bedroom floor thrus. If I keep the half room locked(because it has my personal items inside), would that still be an ‘illegal’ rental?

Here’s a bigger issue than whatever’s legal w/ the city: When your Air BnB tenant accidently sets the house on fire – or when there’s a freak accident and someone gets injured or worse on your property, you’ll be completely SOL. Your insurance won’t cover you for damage, liability or lawsuits resulting from a short-term tenant, legal or not. Is it really worth it to lose your house and go bankrupt over a low-gain, short-term weekend rental to some tourist from LA?

Just received this email today from Airbnb
Wow. Thank you! You and thousands of other Airbnb supporters across New York state stepped up to the plate. You emailed, you tweeted, and you called your legislators. Our message was heard loud and clear — we aren’t going to just sit silently and take it when the hotel lobby comes after our community.
We were more vocal, more organized, and more passionate than ever before. We couldn’t be more proud of the Airbnb community in New York this past week. Unfortunately, the well-funded and deeply entrenched hotel lobby used its influence to push through an anti-home sharing bill that will hurt New York’s economy and make it more difficult for thousands of middle class New Yorkers to make ends meet.
Please know that as of today, this law is NOT yet on the books. That said, we are still working as hard as we can to stop it.
That’s why we need you to send a tweet urging New York Governor Andrew Cuomo to veto the bill. Together, we will do everything we can to make sure this bill doesn’t become reality for New York.

If signed into law. the bill is a ban on advertising where the short-term rental would be prohibited by law. The bill does not alter the underlying law as to what short-term rentals are legal vs illegal. Nor would it alter the insurance risk as discussed above.
