What recourse do owners of a new construction condo have in dealing with sponsor/developer who is ignoring problems that are arising in a building?

just a follow up: have any of you reached a resolution? After constant harrassing, I did finally manage to get the leak fixed. We are now left with a water damaged ceiling that we are going to get an estimate for, and then take them to (small) claims court.

We have been owners of a unit in a 6 floor 12 unit condo that has been operating almost two years. The sponsor has been ignoring concerns of leaking roof among other things. What recourse do we have, before contacting a lawyer?

Hi, unfortunately, we have run into this problem with our building too. The implied housing warranty does still apply to plumbing and electrical stuff in individual units in your case, but we were told that the roof is a trickier question. First of all, is the roof problem in a common area? Because that is apparently not within their scope. Aside from calling a lawyer (which may be your best bet, just to get a letter written, etc) you can also contact the attorney general’s office. They deal with this stuff and can force the developper to deal with it if they find that they are liable. And if nothing else, threatening to call the AG’s office can sometimes get results. Good luck, this is very frustrating stuff…..

My building is facing the same issue.   Leaking roof has caused damage to walls and floors since building went up a few years ago.  And now to top it off we have a mold problem.  We are considering suing developer.  To move ahead we plan to hire an engineer to do a full report.  It was suggested we get a copy of plans filed with city and see how they compare with actual work done.   …it’s awful even thinking about the time and money that will be wasted on this problem.  But housing is damn expensive and just on principle we feel taken advantage of.  Good luck…
