So window guards are ONLY necessary if you have a child <10 yrs f age living in the home? No kids in my home, of any age.... it says "The law requires that window guards are installed: "if you live in a building that has three or more apartments and a child 10 and under lives in your apartment, even if you live on the first floor."

My apartment is what used to be the ballroom of a hotel — before it went co-op. So it has very high ceilings and windows that can be seen from BBridge, lower Manhattan, etc. Ergo the Landmarks Commission being in the mix. Look, I just want to be able to open my windows, to wash them, to get fresh air in my apartment. And I need help interpreting the NYC Bldg Code and figuring out my legal options.

There are 5 sets of windows, each set is 19′ tall, very vertical, casement. Building is Landmark so required to replace with windows that look like the old ones. no-permitz, you saw “vent limiters” are now required — is that what these are? They certainly limit the amount of air I can breathe, as in none. If they are legally required, why are all the rest of the windows in the ENTIRE building fuly openable? And the old windows on one side of my space were not replaced — they open fully at ground level, meaning a dog or toddler could literally walk out into 26th story air. Those are apparently legal, while the new ones, well above toddler & pet levels, can never again in my entire life be opened? I can’t wash them, get air — I paid a fortune only to find myself living in prison!!!!!

They are casement windows. I did retain an attorney, but he hit a wall — Old Board, Co-op lawyer in place 20 yrs, architecture firm in place 10 yrs — all rigid. My attorney said I need to hire a powerhouse law firm and sue the co-op, but that =s suing your neighbors, and would be very ugly. I need somebody who really knows the building code who can ubmit a clear brief disputing application of the code in this manner. BTW, I am the ONLY resident treated this way — everybody else, 400+ units, can open their windows fully

Don’t even tghink of buying them. Ours are so frail. Some don’t close properly. One won’t even open. They leak. Support is non-existent, after the first few months. The mechanism is obscure, but Kolbe Kolbe won’t share any info about how to work on these windows … and they want exhorbitant prices for thewir staff to come and do what I could do if they published some information.

Sounds like the board is making an error. Is there a new board, a new lawyer, new management company — something to explain the change of policy? Not sure what the proper procedure is — perhaps a letter from your lawyer to the board requesting they be removed? Just curious what type of windows you have — double hung, casement, etc.?

The bars are discreet — they attach at the top and bottom of the windows and limit how far outward you can open them — 4″ is the max. They are attached with a special key, which the Board possesses and refuses to give me unless I take on all indemnification. They are citing a NYC Code :
“This is a safety feature to prevent small children or animals falling through. Per Building Code section 1405.13.2 and associated sections where the opening of a sill portion of an operable window is located more than 72” above finished grade it shall have a fixed glazing opening through which a 4-inch diameter sphere cannot pass, with exceptions allowed for windows with approved window guards installed.”

The thing is, that code section refers to R3 residences, defined as “monastaries, convents and facilities for the mentally disabled.”

There are no children in my home, and annually I sign a statement to the City stating that, as does everybody in the building — so all the other windows in the entire building open fully, from the 30th story to the 1st.
