If he is not at fault, nope. He is not making a claim against his own insurance company. They wouldn’t even know about the claim. If Donatella made a claim against his insurance company, his rates might go up. In order to do that, however, the police report would have to show that he was at partial fault. From what Donatella is stating, however, she is the culpable party.

I just checked with my friend – you don’t sue the person, just a claim to the insurance company. He was really insured; has a steel rod from knee to ankle, a steel plate and screws in his leg.
I’m no scared to bring my car out here. I didn’t worry too much about stuff like this back home. Mostly because we don’t have near as much insurance fraud as NY/NJ and also because law enforcement actually enforces traffic laws like speeding, illegal turns, and running red lights.
