Courts don’t let cases get through anymore unless the claimant can show loss of use of a major body part/bodily function for 90/180 days following the accident. This has to be shown during what’s called a threshold motion. Very few claimants make it past the threshold motion unless the accident was VERY serious. At 5mph he doesn’t stand a chance. Best he can do is get a few sessions of p.t. through the no-fault provisions of his own insurance co.

THe person at fault will maybe have their rates go up. Dona, if you’re a good customer (ie, long term customer with no history of claims until now) they will look at your record, they will look at Ruskie’s record. Even if they decide cheaper to pay than to fight, if the claim stinks you are not automatically hit with a rate increase.
