if there were any constitutional challenges to the Bush administration, they would have been played out when the dems took over congress in 2008.

Bush insider or partisan.
second, constitutional challenges were mounted routinely to Bush policy, he won some he lost others at Guantanamo,
all the while, the Supreme court decisions were respected.
I don’t recall Bush standing at a state of the Union address calling out the non-partisan (by law) Supreme Court justices as being “wrong”.
This President has no regard for the Constitution, he has said so in not so many words,
