    put it this way, if I have a group of med students around me and I’m in a panel discussion and I make the following statement:

    “…of course we all know that doctors would never pad their insurance bill for services…”

    and the audience laughs with the implied incredulity of my statement,

    it’s basically a statement that it is a well known practice and being endorsed to a certain extent.

    My statement should be this;

    “…of course we all know that if doctors pad their insurance bill for services this is called fraud.”

    with a silence from the audience.

    the 9th circuit court in California has been spanked repeatedly for this practice and yet they continue.

  2. Back in my office for a minute (and of course, I have to check in on the OT).

    Slopey and all;

    I am not knowledgable enough to say one way or another if the Democrats’ maneuvers are skirting the Constitution. I do know this: it is obvious to the majority of the American people that they are being too clever by half. The bill is not popular, and all of this maneuvering is an attempt to somehow get it passed, and at the same time, have the Reps from moderate areas avoid actually voting on it again.

    I believe the Democrats are going to pay a heavy price for these tactics, come this November. I also believe that the mandate will be found to be unconstitutional, which will effectively gut the bill. Time will tell.
