As for the boards, it is a tricky question in my mind, legally and practically, and I do not have an answer. If a board entrusts a qualified professional to provide investment advice, how far must they go in kicking the tires on that advice to exercise their fiduciary duties?
slope….I think all of those advisors have a responsibility in the matter. There were many advisors who told clients to stay away after doing no more than cursory analysis. One of my colleagues here advised one of her clients years ago that it smelled fishy.
It’s also bringing up the unfortunate issue of the ability or lack thereof of the boards of directors for these schools, endowmwnts and charities to make fiduciary decision.
Global warming isn’t just predicated on statistics. Biologists, geologists, environmental scientists all have input. While I think the eco-alarmists overstate their case, there are enough scientists and enough research to give them the ammunition they need. If nothing else, Gore brought a lot of attention to environmental issues and they are issues that can’t be ignored. I have a friend who doesn’t believe in global warming at all. I found that really shocking- sweeping years of scientific research off the table because she doesn’t believe in science.
There will of course be justified outrage if what you said pans out, but it will be interesting to see how hard the advisors kicked the tires before placing money with Madoff. Just because Madoff should rot in jail doesn’t mean that others’ fiduciary (and statutory, perhaps) duties aren’t in play. I have no involvement in this personally or professionally, but I am really curious how it plays out.
