Leader to sewer drain connection - what's the code?
I’m not sure what kind of building your negihbor is in but here are Multiple Dwelling Law requirements: **Sec. 77\. Plumbing and drainage.** 3\. All roofs, terraces, shafts, courts, areas and yards in every multiple dwelling shall be properly graded, drained and connected with a street storm-water main or combined sewer and street storm-water main so that all storm water may pass freely into it, except that where no street storm-water main or combined sewer and street storm-water main exists, the department may permit the storm water from such areas and spaces to drain into a street gutter which leads to a natural channel or water course, or into a dry well. When required by the department, the shafts, courts, areas and yards shall be properly concreted. Every roof shall be so drained that all storm water shall be conveyed therefrom in a manner that will prevent dripping to the ground or the causing of dampness in walls, ceilings, yards, shafts or areas. Nothing in this section shall be deemed to prevent the turfing over of any yard or court space or the planting of shrubs or trees therein when approved by the department

In prep for the hurricane, my neighbor (we don’t speak, but that’s another story) disconnected the leader to sewer connection of his house – which sits on the side which is adjacent to my private driveway. He has covered the drain and installed a bypass where the water (and leaves) from his gutter drain into my driveway instead of the sewer drain. As the hurricane was a major event, I let this slide. Now months later they still have not re-connected. Not only is my driveway now always wet and full of leaves from this, but freezing temps are coming and this will cause the water to ice down the driveway and a sliding/falling risk for passers-by as it freezes down to the sidewalk – for which I will be liable! Before I approach them, I wondered if there was some sort of code on the connection of the leader to the sewer drain i could reference, so I had my facts straight, Appreciate any info on this. Thanks!

It is illegal to dispose rain water to the street, unless your roof is used as excessive rain water storage and then it has overflow.

I don’t think there’s anything in the building code that would require draining into the sewer or prevent draining from the gutter onto his property. If the change he made is causing you damage, you could sue. I don’t know if you’d be likely to prevail under NY law. Alternatively you could do something to to divert water from your driveway (drainage ditch, for example).
