asbestos abatement in detached single family

There may be non-friable asbestos floor tiles in the house we are buying. Federal law does not require you to hire an asbestos professional for non-friable material in a single family detached. In other states I have lived in, these floor tiles could be removed by the homeowner. Does NYC have a n additional requirement that small scale non friable work needs a professional abater?

All of the info I am finding seems to be geared toward apartment buildings and large building projects. Thank you so much if you have any information or personal experience.

I believe we were charged $27 per sample, and the inspector had to take 2 samples of each material sampled. Sucked for us because we had like 25 different patterns of linoluem in the house (many layers) so our inspection was a fortune (almost $3k) but luckily the only thing that popped was the exterior.

I was told by my expeditor to abate before filing. There is no law that says a homeowner can’t do himself. The main concern seems to be proper disposal. The quotes I received were ridiculous (from $12k to $25). So I did everything myself, after thorough research and lots of precautions. Then the expeditor took some samples for testing, the filed. I was charged around $600 per sample tested. Afterwords, I remember seeing a testing facility somewhere in Long Island City that charges along the lines of $30/sample. Was too late for me, but maybe worth looking into.

You can also get your own asbestos test kit to determine if this is even an issue before you file for your permits. You might be fine- we had 7 layers of linoleum in our house in some rooms dating back to pre 1945 and none of them were asbestos, just the exterior shingles.

Not that would EVER endorse such a thing, but people are saying that you can hire people to do this prior to filings permits as well. To be clear, I’m not the one saying it, I’ve just heard that some people were saying it…

Thanks Lurker. I just don’t see the logic in the removal quotes, especially when they contradict EPA guidelines. I can see the importance of extra precaution but this is just exploitation. As I delve deeper into renovation I am getting the feeling that a lot of building code is political and heavily influenced by lobbyists. $20,000 to $30,000 for taking out some peel n’ stick tiles, seems a bit excessive.

Ordinarily I’m on the other side of such issues but the quotes we got, and the straight up head-shaking, confessional interactions I had with abatement company workers essentially apologizing for the cost informed my experience. Just to test all the possible locations where we intended to do work– some walls, a ceiling, floor tiles, etc, cost us upwards of $1,500 or more, and this from the cheap independent guy. A friend told us the same thing for a renovation project where they had like 25 feet of pipe insulation, and were given an estimate that included hourly air sampling and testing, on-site showers and a negative air flow setup, thus multiple days of work, plus disposal etc and was like 30k. Totally insane and rapacious.

I just looked it up and technically if you are the homeowner and have not filed permits for work yet and don’t hire workers you can legally remove and dispose of asbestos yourself. I don’t think you can knowingly hire someone to do the work though. Personally I wouldn’t do so with friable stuff like pipe covers, or demoing textured paint (popc orn ceiling paint is usually asbestos), but for tiles and similarly solid stuff I wouldn’t pay 10s of thousands, and instead do it myself.

Lurker – ditto! Agree with everything you say. With the right precautions, it’s pretty safe to do yourself. I guess there are so many people unwilling to do the research and happy to pay ridiculous amounts to someone else, prices are getting out of hand.

This is such an irksome, confounding topic. For decades and even now, in many states including exceedingly health-conscious and regulation heavy California, you are allowed to dispose of non-friable yourself (and friable too up to a certain amount).

The problem with asbestos is 1) inhaling lots of tiny particles 2) consistently 3) over a long time. The latter two are the rub. It’s not something you get a whiff of and then the next day have mesothelioma. Tiles that are largely intact and not powdery, like pipe insulation, just really aren’t a risk. So if you don’t sand the tiles and simply wet them as a precaution, wear a dust suit that you throw away after, a hepa filter and so on, lift them into garbage and dispose of them in sealed bags, it just isn’t going to be a problem. The only issue is the neighbors saying something if you walk outside in a clean suit, or have 25 bags of the stuff.

You shouldn’t take needless health risks so if you are nervous then pay someone, and I’m not one for polluting others out of convenience, but the asbestos risk is a bizarrely poli tical and economic ginned up problem. Asbestos can be dangerous if silently filtering dust particles into your breathing air, but the cottage industry of disposal is a ridiculous scam. Tiles in the dump will never harm anyone. This told to me by both asbestos inspector and 2 guys who quoted me on abatement. BTW they all think fiberglass will be the next asbestos.

We needed to have our rear facade abated when we added our extension. It was $7k. If we were to have abated the roof, that would have been an additional $12k.

Thanks jimhillra! I was going to get the asbestos tile taken care of before we put any work permits in for anything so that our inspections would go smoothly. The first abatement company quoted me $25,000, a lot I thought for removing vinyl tile from a few small bedrooms. They said the quote was higher because there may be multiple layers of floor covering. Hopefully other quotes are cheaper or I can do it myself safely. Thanks again!

NYC is different. EVERY job that gets filed with the DOB needs an asbestos inspection. Depending upon the type and amount of asbestos, you may be able to do it without a professional abatement service. Most often, when we encounter it, the homeowner hires an abatement company to remove it prior to filing. Most abatement jobs can be performed by a licensed abatement company without filing with the DOB, thereby reducing the amount of work & money it takes to abate it.

Are you doing renovation work? I would be shocked if you could pull permits without getting this professionally abated. We are a single-family home and we had to have an inspection and a professional abatement.
