Lease template?
Hi all. New landlady here, in a two-family house, renting the top floor. Do you have any recommendations for lease templates? What do you use? I looked at the REBNY lease, and found it to be unnecessarily antagonistic to the tenant. I’m hoping someone can recommend one that’s a little more balanced. I will be living with these folks, after all, and want to maintain a mutually respectful and friendly relationship with them. Thanks for your thoughts! Karen

Even though the tenant is living in your house it is a business relationship. Be neighborly but remember your tenant is not your friend or you theirs. Besides the window guard rider, the lead paint rider; it is also good to have the emergency contact rider (who do you call if heaven forbid your tenant dies on you!, or becomes really incapacitated and you need to contact a family member etc.) Also house rules: Late charge if rent is not received by the 5th if due on the first, recycling garbage, where can they put their bike, pets, extra locks on doors etc.

Another rider to Blumberg is a clause that makes each signer fully responsible for the entire rent. This prevents ugly scenes in the event that one tenant moves out and the one left behind assumes that his/her rent is only 1/2 of the total rent. A lawyer can give you more correct language.

I agree about using Blumberg. I add to mine that tenants are responsible for being compliant w/ NYC rubbish & recycling regulations.

The lease package RSA sells should have all the required paperwork. https://rsanyc.net/FMS/forms/4.html They sell both stabilized and non-stabilized leases because one landlord can have both in one building.

Thanks! The Blumberg lease does look more reasonable. And I ordered the RSA lease too, as you suggested, but it turns out I won’t be seeing it for a couple of days because they’re sending it in hard copy. (!) On top of the lease I’m required to add riders about window guards and lead paint, right? Are those it? (I have an email in to my lawyer too, but I bet you guys know even better than he does.)

@knassi, blumberg t186 with your own rider if you want to add anything. like others said, don’t remove or change language. the tenants aren’t your friends. not saying you can’t be friendly, but make sure you draw a well defined line in the relationship.

We’ve been using a slightly modified Blumberg form for our rental for 30 years. We have never had a tenant object to it or be offended by it. I don’t think they have even read it before signing (and this includes young lawyers). As Slopefarm suggested, just be a good landlord and no one will be offended. (I think that probably especially true in recent years, where people a used to clicking on **I Agree** on their computer or smart phone.)

You might try the Blumberg form instead. It provides adequate landlord protection but perhaps uses a more balanced tone.

Don’t start removing language. It is there to protect you too. You never know how tenants are going to turn out. As a first time landlady, I would consult a lawyer before you start altering leases. Of course you can always add additional riders about no smoking, pets, etc.

Use the standard form. Anyone who’s rented has seen it before. If there is something you want to change, do it in a rider. Then, just be a nice landlord.
