Is live-in babysitter considered a tenant?
If you are going to speak with an attorney, make sure its a really good L/T lawyer. It sounds like trouble to me with the husband having to live there.

Hi we need to hire a live-in babysitter for six weeks. The candidate asked to have her husband live with her as well. So what do I need to do to ensure that she moves out at the end of the agreed term? At what point the babysitter considered to be a tenant and can use tenant rights to stay in? Do I need to check this subject with the lawyer? PS sorry, I wrote another earler post, but could not fix it.

Why on earth would the husband need to stay as well? (Red flag!) Are they otherwise homeless? As another person said; resident for 30 days and yes you may well find yourself needing to take the case to Landlord – tenant court. At least 60-90 days and legal bills. Will they be staying in a separate legal apartment or a room in your home? Even if you had a written and signed understanding of them vacating, moving out on a certain day etc., they do have rights ( tenants/occupants can never sign their rights away, unless they are also represented by an attorney.) But even then, if you lock them out or put their stuff out on the street, the Police will arrest you. I know of a very similar incident, the Police made the owner pay a weeks hotel bill for the person that was supposed to no longer be in her house. (A house sitter)

Yes, you should speak with a lawyer (or lawyers–someone familiar with both labor law and landlord-tenant law). And, yes, I agree the husband is a red flag, though the devil is in the details and possibly not a dealbreaker. Will husband be working for you, too? Do you plan on an employment contract (with nanny and separately with husband)? Will living arrangement be allowed only under condition of nanny’s employment? How much would the unit rent for at fair market? Is your unit even legally rentable? How much are you reducing salary in exchange for room, or is it room and board? Depending on written or unwritten terms, nanny and husband could be roommates, tenants, licensees or possibly squatters. They would stay in a separate room, but not in a separate “legal apartment”. I need her for 45 days. Can I do something to get around the 30 days limit? Any recommendation on a lawyer?
