A tenant is someone that signs the lease &/or that you accept rent from. So do not accept rent from anyone that you do not want to have tenants rights. A canceled check is all that trouble makers need to prove a right to be in your building.

New York Real Property Law § 235-f. 1.b. “Occupant” means a person, other than a tenant or a member of a tenant’s immediate family, occupying a premises with the consent of the tenant or tenants.

Point well taken. There is a lot of good advice here on a lot of topics, but i would not rely on this forum (and not on my comments) for legal advice. Sometimes it is helpful to get a few answers here just to have more of a sense of parameters and how to talk about an issue when you consult with a lawyer.

Not my area of law, but I would imagine an “occupant” is someone living in the unit who is not a signatory (i.e. did not sign the lease). the tenants’ child, or a roommate, etc. The tenants are the people identified as the contractual parties on the lease and who sign it. Hopefully someone else will chime in who can nail this down.
