Help! Moved into Greenpoint Building - no hot water, gas to cook, and internet

National grid told me to reach out to landlord, because the building had not been set up. Landlord tells me it could take up to 5 weeks until we have gas to cook. He also said it could be weeks until we have hot water. Our internet guy came out today, spent an hour in our apartment and said the building is restricted, and unable to set up internet. This is a brand new building, what sort of legal action can we take? Deny rent?

Thank you for all the comments. You are all probably right of the C of O, but the landlord has turned out to be a stand up guy lately. We have found out internet was not a problem, just the box that had to be accessed was hidden in one of the tenants rooms. Also, finally got hot water yesterday. Because of the inconvenience, he has pro-rated our rent in August for every day that we did not have hot water. So, looking at paying half the rent in August…not too shabby. The only thing left on the list is gas to cook, which is still a huge problem. However, I understand all these issues tend to happen in new buildings. The neighborhood is awesome so at this time, going to relax and enjoy it. Thanks again for the tips!

A c of o is not always neede if the bldg was filled under a alt 2 a signoff is enough and and u get a letter of completion. I would suggest you ask for a rent credit.

I would move out immediately. Get a lawyer, and try to get your money back. After years of living in a terrible building, I can say it’s not worth the frustration to fight a shady landlord who doesn’t maintain a property. We moved into a “new” construction building 5 years ago and immediately had problems with a no show landlord, no hot water, no heat, locks on building doors not working, leaking pipes, walls and ceilings, mold, etc. You name it, everything went wrong. Turns out is was a zombie building that had sat empty for awhile and never been properly finished. We spent 2 years fighting the landlord and sometimes paying rent into an escrow account when they wouldn’t respond. We threatened legal action several times, as did most of the other tenants. We hired our own vendors for repairs and took it out of the rent. The landlord finally got their act together, somewhat, about a year ago. But shady is shady. We decided to stop wasting our time and we’re moving out soon. Looking back, we should have left right away. It wasn’t worth the frustration. Next time do a ton of research on the building and landlord before you rent. If something feels wrong, it is. Good luck!

You moved into a building with no C of O so they are not allowed to give you a lease. I know this because I moved into those tacky Taffe Place Lofts under the exact same circumstances when they first launched. You can withhold but you MUST put funds into an escrow account and you can sue for reductions. After a year, we moved after paying on time every month and leaving the place spotless and they refused to return our deposit so I sued them in small claims for the maximum and won as by that time I wad so angry that I wanted to stick it to them. I’d suggest contacting a lawyer and if you can’t afford one go to the volunteer attorneys in housing court. I’m a landlord and I think we get the shaft 95% of the time in court but its there to protect from slumlords like yours…they give the rest of us a bad name. I’d also approach them AFTER you speak with an attorney and have a better handle on your rights and basically tell them you aren’t paying rent and will be out in say 90 days and get an agreement in place saying they won’t take you t LL/tenant court but you’ll leave peacefully and on time. Get together with all the other tenants. Then, get a lawyer involved. Ask his advice on putting rent into escrow account. How was the lack of gas and hot water not evident before you moved in?? Get a Verizon Air Card for basic internet access. You won’t really be able to stream with it very well. And, what does “restricted” mean WRT the internet????

How big is the building? Are there other tenants? You signed a lease that stipulates amenities such as hot water. I’m sure there are laws that aren’t being followed. Phone 311 & see where they direct you. If you get someone who isn’t helpful, just keep phoning back until you get a good one – there are operators who really know their stuff.
