Is this a true statement? If you own a 2-family house, you do not need a reason to evict a tenant.
I have the most undesirable tenant who wants to make my life miserable. I need her to leave. She has not paid for the month of june saying she will pay when she wants to. She has not been in the apt that she shares with her roommate (the roommate is great and wants the apt for her and his fiance) for at least a month if not more. I called several times with no respond. I heard that she is now leaving with the kids. The lady is a demented 60 years old woman. But her stuff is still in her room. She finally called me back and we agreed that she would leave end of June. Then her daughter sends me a menacing threatening text after I sent a text confirming that her mother must move at the end of june. We do have a lease. The lease ends August 1\. I said to her I want you to leave and you want to leave so leave end of June. I have changed the lock of the apt saying to her she will not have access to the apt until she give me the rent. She does not answer her phone. She is using her daughter to speak to me. But I do not respond to the daughter because she is not the person I have the lease with. Help.

To Dh who wrote you are not very smart…you are not very smart or helpful for saying that. This forum is for people who want to be helpful not insulting.
I changed the lock on the purpose knowing that it is not legal. The law in this case is trying to protect someone who do not deserve protection. I am taking my chances. She has not been at the apt for two months because she wants to use the law not to pay me and scare me. I do not scare very easily and i know how far i can take it. I know what I am dealing with since she has lived in my house for two years. The demented tenant (60 years old woman) plus the wonderful tenant (52 years old woman) are on the lease. I am happy to give the demented tenant the new key when she shows up at the apt but she has to pay me the rent first. Let’s not talk about the fees she owes for late payment. I have expressed to her that I will not renew her lease in August. I have even expressed to her that she can break the lease and leave in June or July. I have no idea where she lives so I can’t say all of these things in writing. I can do it on the phone or over text message. (actually I just got an idea as I am writing this). She is doing all of this so I can’t keep a solid paper trail. But she will not win. i would love recommendations on good and inexpensive lawyers just in case I need one later. I am hoping she will move out of her room on her own because she is not in the position to take this court.

Who is the primary tenant? Whose name is on the lease: the woman “who wants to make [your] life miserable” or the “the roommate [who] is great”? Tenants, with specific limitations, have the legal right to have roommates. Your post demonstrates that you do not have the knowledge or skills to handle this situation properly. You cannot change the locks. That is illegal and as bowl_of_dicks said, she can now go after you. While you aren’t required to deal with the daughter, the reality is she is the one dealing with you. Talk to a lawyer and work something out with these people before you have a much bigger nightmare on your hands.

hey landlords!!!! this is why you never EVER EVER EVER rent to females between the ages of 21 and 31\. EVER. they are NIGHTMARES, especially if they are non coastal people… (i.e. people from the middle gullet of the country). save yourself the time and hassle, never rent to them. they are not a protected class, so you aint discriminating, dont worry.

Is ense there’s two sides to this story by the way you described the situation.
That said, your tenant has a lease until Aug 1 and you cannot change the locks. After that, you can decide to not renew the lease. you better give her proper notice. After that, if she doesn’t move out you need to get a lawyer and take her to court. No, you don’t actually have to deal with the daighter.

Buildings with fewer than six units are not subject to the Rent Stabilization Code, however, it is remotely possible (if the tenant has been there for a very, very long time) that the tenant is rent controlled. If the tenant is unregulated, you don’t have to offer a renewal lease and can give the notice required in the lease to terminate at the end of the lease. If the tenant is month to month, you can give the one month’s notice. You cannot discriminate against protected classes of tenant.

This statement IS true: it is absolutely illegal to lock a tenant out of their apartment.
