Get an attorney.  Now.  I hestitate to kick a guy when he is down, but I venture to say you are in this situation because being laid back has been more important to you than being a business person.  People like your tenant LOVE to take advantage of nice people like you.  The forged W-2, IMO, isn’t relevant and is more of a distraction.  So, again, hire an attorney and follow his advice to the letter.  Good luck.  (Yes, I am a landlord.  No, I am not an attorney).

Had such  a nice write up about a problem with a tenant that submitted a false w2 form to me but I must have clicked something on the side thinking I was adding to category and it got erased. So now we’re in court and Im just shaking my head because she was a family friend. Anyone ever deal with fraudulent paperwork?

So here is the full story. Back in 2009 I went into contact on a sigle fam home. Closed in October and renovated for four months. Market was still a bit choppy for sellers so a “friend” of min said that the girl he’s dating is looking for a new place. I’ve seen him with her for about 2 years and she seemed like a nice person from what I know. Thought it would be a win-win to rent to her since it would be me time for when the housing market improves. Around Feb. ’09 “friend,” his date, and my wife and i were sitting at our new place discussing the rental and details. I told her the rent and asked that she bring a w2\. Took her about a week to get the w2, and when she did it looked sort of zoomed in. Ask her what happened and she said the copier was acting funny. Was like oh well, glanced at the yearly which was 75K. At 75K I thought for sure she could cover a rent of $1425, which was the exact cost of my mortgage and maintenance for the apartment. On the day lease was signed, my very first time at being a landlord might I add, she paid one month security, along with two months rent. That would actually turn out to be the only time she EVER paid on time. So rent was then due on the coming months, and it would arrive later and later. It went from coming on the 5th, then the 8th, then the 15th, to on the 14th month NO LONGER coming. Even when she missed a month I didnt stress her. Sent her a text asking what’s the story and she replied saying that she was sick and that her check was messed up. That’s when something clicked to look at her w2’s. You would think that someone making 75K would have a few months rent saved. Looking at it it didnt add up and things we’re blurry. I asked her about it and she got all defensive and never even answered whether it was a legit w2 or not. Asked my “friend” whether he knew about it he said no, and everytime he would speak to her she would say everything is fine. So then she missed the next month and I two weeks ago decided to start the eviction process. We have a court date for next month but I’m sure she’s not going to pay October. Funny thing on her reponse she checked “other” and put the issue as “landlord problems.” News to me since I was always laid back and only voiced my opinion when she was 3 weeks late, and even then most i did was ask her via phone when I can expect a rent payment. You don’t have an attorney?  If your tenant does, and you don’t, you could be at a disadvantage.   That would really stink given that you have been rather lenient towards this person.

In any case you can chalk this up to a learning experience. Anyone on Brownstoner who has rented to more than a few people will tell you have to pull a credit report, get bank statements, current paystubs and ex-landlord references (although this is a complicated issue) at a minimum. It’s likely that problems would have been detected in advance as in my experience people don’t suddenly turn into delinquent tenants overnight. More times than not they have a history of this. I don’t have an attorney, as I’m trying to keep my cost down. I did all the paper work by myself. I was actually hoping that when she saw mailing that she wouldn’t reply and just maybe even leave at the end of the month. NOPE, she replies back with “landlord problem.” I will call the DA’s office and ask on money as well as go back to housing court early in the morning to speak to a lawyer about the falsified w2. it’s sad that people use false pretences to find a place. it is incredibly easy to forge a credit report and most documents. It’s even worse that she made a fake w2… you can download one from the IRS for free and fill it out yourself! next time you rent out, i recommend you use a broker to find you a tenant. they will run a background check and credit report and can act as the third party which can make sure the tenant is who they represent to be. Nothing is 100% in this world, but it definitely helps.

FYI, I don’t think a Housing Court judge will give a rat’s _ss that she forged a W-2\. The fact is you signed a lease with her so the judge will likely treat this the same as the other twenty cases he/she has that day. If she’s talked to anyone she’ll have a list of (possibly bogus) repairs that need to be done and the judge will adjourn it for three weeks and get a Housing Inspector out there in the interim. I feel your pain….
