It really doesn’t matter if you get people on here to agree with you about not turning the heat on when it seems warm enough, or so they think, that they don’t need to put the heat on.  The law is what matters, tanner, and you should set your thermostat accordingly in these fall months.  And if you don’t set it higher than the law requires when it really does get cold out, then you’ll have a hard time keeping tenants, even if you are within the letter of the law, as the law states the bare minimum, and not what is comfortable.

Most landlords are buisness people.  If you occupy your home and have a couple of tennants, that’s one thing.  If you own several building and tennants don’t controll their own heat, that’s something else.   Once tenants have to pay for their own heat and hot water, its amazing how suddenly cost is an issue. So, I guess “decent enough” could be defined differently that tanners assumption. I have a one family and heat with wood during the early months of the cold season.

I always left the thermostat set around 70 so it would come on whenever needed.

It does not say the heat has to be on. It states indoor and outdoor temperatures. This is reading comprehension. With the ability of masonry to retain heat, the actual temperature of the outside air at a building in a dense urban setting and the fact that the temperature may be below 55 only two to three hours a day, some years it is actually possible to maintain code temperature well into October.

The NYC Heat Regs are insane. Who keeps the indoor temp anywhere as low as 55, ever?? And yes, it dipped beneath 55 outside, so does that mean everyone has turned the heat on?  It was so humid the other day, my tenants were running their window AC.  But then at night it dipped below 55\. So. Just wondering, in actual practice, who has turned theirs on yet.

if it feels cold in the house I turn on the heat – actually it comes on automatically since I leave the pilot on year round and the thermostat at 70

NYC Heat Regs:  From Oct. 1 to May 31, if the mercury dips beneath 55 degrees, building owners must maintain indoor temperatures of at least 68 degrees between 6a.m. and 10p.m. Between 10p.m. and 6a.m., landlords must keep indoor temperatures at 55 degrees if it’s under 40 degrees outside.
