Wrong classification with DOF, bank wants escrow to fix

I’d be more optimistic if this were a big bank with an out of state underwriter, who is susceptible to a “you don’t understand NYC” argument. Still, if it were me I’d push back once with a “why do you need this, it doesn’t make sense?” inquiry and they might say something you can work with.

Hoping someone can help.
At the very end of a long refi, rate expires next week, bank attorney flagged that our brownstone is taxed as a two family with department of finance but instead it is a three family, they want escrow until we fix the issue. Any idea who i need to contact or if i can hire someone please? My attorney says there should not be any increase in taxes or back taxes owed when we notify DOF. We purchased the property one year ago.

Bigger issue: what does the CofO say? If it is a legal 2 family and you are using it as a 3 family, that is a much bigger deal than just notifying DOF.

DOF has to come out and reasses/reclassify the building. It takes a few months, but it is easy and get ready for your real estate taxes to go through the roof. If the escrow is small enough I’d just kiss that money goodbye and not involve the DOF.

I am pretty sure that one and two family homes are a different classification than three families which are considered a multiple dwelling or something like that and are taxed at a much higher rate. I think No Permitz is saying that getting DOF involved will most likely raise your taxes and end up negating any savings you get through the refi.

To change this, you would be a physical inspection by DOF and a reassessment. A reassessment is the problem here. You have been capped on tax increases.

i am not sure I understand what the bank’s interest is in this. The house is configured and used consistent with the C/O, and it is in the correct tax class. Some smart lawyering should convince the bank to drop the issue.

Drop the refi process with this lender and go through a broker like Adam Dahill. Never heard of this being an issue before.

I do agree with slope farm and dave.

You really don’t want to open this can of worms with the DOF. It’s going to take a year or two for a new tax bill. If you haven’t done any work and your taxes are low, they are going to bang you.

Thank you all for the replies. I was told by couple of attorneys today that this is a clerical error at dof, 3 fam is same tax class as a 2. I did work recently, a gut, but no c of o change, waiting to get hit with taxes soon. But i was told an online form at Dof is all i need to fill up. I hope this is the case.

I really would try having your lawyer try to get the bank to back off this point first. It makes no sense why the bank needs this to close on the loan. A well-informed lawyer, one phone call, might just do the trick.
