Sidewalk Lien Violation and refinancing
city has no $$$.
I would be shocked if your bank cared as its not on title and they know you have homeowners (contains liability) insurance as required for closing. .

In the middle of a refinance and just remembered I have a sidewalk violation from many years ago for trip hazard on my property. I remember it being a pain to fix. Tried to get Parks to fix it back then because it was related to my neighbor’s tree roots. They said it wasn’t the tree even though that’s the only reason the ground was coming up. Maybe because the tree wasn’t right outside my house? The neighbor’s tree was actually worked on by Parks for free so we saw the roots coming to our side when they dug the concrete up. But I guess by the time Parks came to inspect our site, the neighbor’s tree and sidewalk was already fixed nicely.
DOT then ended up posting a sign on my door and said they would fix, but they never came, and I just forgot about it after trying to track them down endlessly. Recently, I had some driveway work done and the workers ended up grinding down the trip hazard so that it is smoother (i have kids playing outside)
Now I have decided to refinance and it occurred to me this violation might be an issue. Anyone have any experience with a refi and clearing sidewalk violation? The original trip hazard itself wasn’t that big so I am hoping the bank will see that it isn’t an expensive problem. Ideally, I’d like to clear the violation but I’m, not sure it was done properly since the workers didn’t get a permit. (I didn’t hire them for that specific reason, they just ground the trip hazard down as a favor for me). I don’t even know if it counts as patchwork since they didn’t replace the whole square and just ground down the cement.
Anyone also have any good outcome from having their sidewalk lien removed with the new program by DeBlasio, which apparently would remove a sidewalk lien due to city trees? Thanks.

It’s just a violation that carries no penalty, no issue. I have one as well, waiting for many years for them to come fix it and bill me. It goes through your community board for some reason

I always wondered what happens if you get a notice to repair it and then someone gets injured on your sidewalk while waiting for it to be repaired.
Will the insurance company cover it if the city notified you there was a dangerous issue and you didn’t remedy it? Or will it look like you were negligent after you were given formal notice of a dangerous situation?

Oh really? @no-permitz I thought maybe the title company would take issue to it during the refi. I know when I bought the place, I had to have money in escrow to have it fixed. Years later and the city still hasn’t fixed it.

@JohnHancock yes i have been waiting forever. A few years ago they put the cones down, drew marks on the sidewalk, and I thought this would be the year. Then they never came to fix it. I got mixed answers why, but basically that the community board ran out of money in the budget. They do the more hazardous stuff first and could be a couple years before they work with the particular community board again. Another person told me it got moved to Parks because of the trees. Definitely didn’t get straight answers but just hope I don’t have to hire a private contractor to remove the lien for the refi to go through.

They’re bogus violations anyway, some guy comes by, writes up practically the whole block mostly for no real reason. Then they offer to fix it for you and bill you for it which they then won’t do. The abandoned properties that have the worst sidewalks are left like this for decades and nobody does anything, same thing with snow and ice removal. There’s 2000 laws and regulations but 0 enforcement

I don’t know why people wait for the city to repair a hazardous sidewalk. They may fix it, they may not, and if you have bluestone they won’t touch it. But in the meantime, you could get hit with a trip and fall lawsuit.

Most of these “violations” aren’t close to being hazardous. Mine are just cracks in the concrete with no difference in height, couldn’t trip on it if you tried, so are most of my neighbors. I don’t believe you have a lien though, just a violation, there’s no penalty or fine and yes you can just get a private contractor to pull the permit and fix it. Most insurance companies require you to fix it anyway when you renew

back to what JH says in his first reply. about 10 years ago they wrote our entire block violations for every little sidewalk issue. mine had a cracked corner of a square but was otherwise good. all of us got a letter in the mail saying we could have it repaired ourselves or they would do it and bill us at a rate of $10 and something a square foot if we did not take care of it by a certain date. i liked that they would do this so i took no action. they fixed the sidewalk and never billed us. i never told anyone i did not get a bill thinking they had overlooked me, but thanks to JH i now know this was not an oversight.
i just looked up my address on the dob website and their is no record of a sidewalk violation.

If you ask for a second inspection when you believe there’s no real hazard, the first one is frequently reversed/nullified.

We had a violation for a raised flag and submitted the form to claim it was caused by roots from the adjacent tree. The claim was upheld (its pretty obvious that its tree related). That was in April 2016 and crickets since then. No action on the “violation” and no work to repair the flag. We will wait for the City’s contractor to come in 2030.
Also, when we purchased the house there was an existing violation for the sidewalk. I recall it was not an issue for the mortgage. The seller wanted to escrow funds for the repair; we said no deal unless he repaired the sidewalk. He got the permit, fixed the sidewalk and we closed in short order.

@arkady i think the previous owner had asked for a reinspection and they said the same thing about the trip hazard. Not sure what would happen if I call them out to check again, if it would be a new inspection or re-inspection. We fixed it without the permit just so it’s safe for people to walk on, so I don’t think it would clear the violation/$0 lien if the title company asks about it.

@bored_at_work that’s pretty much what happened to us. Even though we had photos of the neighbor’s tree roots going under our trip hazard they said our site wasn’t eligible for the fix under the Trees and Sidewalks program. So I have to wait a long time for the city’s contractors. I also had the same issue at closing, but took the escrow money since I didn’t want to delay closing. Ended up getting it since the city still hasn’t repaired anything even under the Expedited Repair program.

I was able to deal with that today. You should Call 311 and provide them with your sidewalk violation number to schedule a sidewalk re-inspection with a DOT inspector. They will then email you a service request number where you can check for the status of the violation. An inspector shall inspect the sidewalk within 30 days of appointment and then clear it. @agatascarlen thanks, did you hire a private contractor first to fix your sidewalk before the re-inspection or was your violation minor?
