Plumber took payment for filing permit and never filed permit
@no-permitz – I hear you. But the buyer could hire an architect. Or buyer could use it as a negotiating point – there are no permits pulled for moving the sink.
With an OP-128 there is no inspection required. So if the plumber filed the paperwork and signed off on the job, no inspection from the DOB is required. That’s why OP-128 permits only allow for a limited breadth of work.
I emailed the plumber 24 hours ago. No response. I’ll follow up with a phone call.

I hired a plumber in April 2018 to move some kitchen pipes for me as part of a kitchen remodel. The move was fairly minor. He claims to have filed an OP-128. “Ordinary plumbing report” with the NYC DOB.
I checked the DOB’s website and could not find any record of the OP128 being filed. How should I pursue this plumber to either A) file the correct paperwork B) refund my money for not filing the paperwork? How can I “persuade” him to do the right thing?

If you’re able to contact the plumber you might ask him for a copy of the paperwork that he’s supposed to have filed. I have no direct experience with DOB, but as a retired City managerial employee I know full well that things can get lost. If you can obtain a copy you could follow trough with DOB or, if that’s too daunting a task, your City Council member or the Public Advocate’s office. This is all assuming that the plumber DID file the papers; if not I don’t know how you can “persuade” him, but why not start as if he acted in good faith?

Why bother at this point? Why make more headaches with paperwork if the work is done?

Moving piping is not op128 job. That would be replace in kind. And only sanitary and water piping.

@Bob Marvin – Yes it is possible the paper work got lost. I will contact the plumber and see what he says.
@ no-permitz – The reason I’m pursuing this is b/c I plan to sell my condo in the near. If the buyer looks at the original condo documents and sees the kitchen sink was 9 feet from where it was originally, it could become a headache for me. Having the paper work on file would solve that.
@Gennady of Absolute Mechanical Co Inc – According to NYC DOB Ordinary work permit fact sheet moving a drain and supply lines within 10′ is covered by a OP128. When the wall was opened up it was discovered the new sink location was actually on the run to the main stack. So all the plumber had to do was cut the Cast iron pipe and install a new santee at the new location. The old pipe was abandoned.

Suit yourself. Unless your buyer is an architect of just an a-hole, they are not going ask about this or review plans. What I would be concerned about, aside from the headache of extra time and paperwork, is if DOB wants to see inside the walls and you have to remove the kitchen. Just forget about it.
