Our survey and our neighbor's survey say different things. How to resolve?
We share a driveway with our neighbor. We each have a mutual easement. We like our neighbor and have a good relationship with him. However, we are now doing work on our back yard and we each have a survey with conflicting information. His survey shows his property line being about 1 foot wider than what our survey (and deed) show. We’ve each called our respective surveyors and I have a call into our real estate attorney, but I’m wondering how others have resolved this issue.
It’s an issue because we are redoing our back yard and want to put a fence along part of the property line. We want to have the fence very close to our property line, but, obviously, not on his property. He’s had his survey for many years, so it’s come as quite a shock to him that his property might be one foot narrower than what he’s thought for many years.

Sounds like it’s resolved then.

yes. That is how we got their survey. I talked to my surveyor and he showed me that my neighbor’s survey actually says the same thing that ours does. It’s a bit of a shock to my neighbor for him to realize that he owns less property than he thought he did, but we are okay.

Have you tried to talk to them regarding this matter?
