I think this article in NYT left me troubled not only me but other small landlords as well.

“What does it mean for landlords?
While tenants will be protected for at least 90 days from eviction, landlords have not yet been provided similar protections. Mr. Cuomo has urged banks to waive mortgage payments for three months, but he does not have the authority to order them to do so.

Other bills, such as water and sewer, have not been postponed.

“The banks aren’t going to let you off the hook,” said Mr. Strasburg, adding that the federal government should require banks to provide relief on mortgage payments.”

Basically now we have 0 protection not only if tenants can not pay rent due to income loose or coronavirus illness ( god forbid).
It looks like we have 0 protection if tenants CHOOSE not to pay rent in this difficult time ( and god bless out tenants who gave us rent check for April and other tenants who probably will pay us too, at least they did not state otherwise so far as we are normally very relaxed about strict monthly rent due date).

Also, water bills for typical 3 family full of kids is usually sizable, no pay vacation there.

Taxes are paid by mortgage company from escrow.
On a top we have to provide emergency repairs when something breaks. Can I ask plumber, for example, to do work for free or pay him later? You know the answer.

What to do and where to run if it comes to the situation that we can not cover all our house related bills ( mortgage, utilities, repairs) due to rent not paid by tenants?

NYC always shifts the burden and costs of its shortcomings onto the LL and property owners. They pander and assuage tenants with zero regard for small LL.

Mortgage payments need to be paid – whether its 3 months from now or 30 years from now. It’s not forgiven, it’s just delayed. And that means tenants need to pay.

Did Bernie give up yet? This whole mess will be a great example of how socialism works, or should I say doesn’t work.

And don’t suspend your mortgage unless you absolutely need to. If you do, it will be a long time before you’ll be able to borrow/get a mortgage again (even if it’s not reported to the credit bureaus).

This has nothing to do with Socialism! In a Social Democracy like Denmark, people who lost their job or are quarantined due to the virus are continuing to get paid and so will have no problem with paying their rent (or mortgage) In fact, this is the case in most of Europe. Also, I am under the impression that one of the three Federal coronavirus laws allows a mortgage holder to *defer* 90 days of payments which will be tacked on at the end of the mortgage and that this deferral is not allowed to affect one’s credit rating.

bobjbkln, hearing anecdotal reports from readers and commenters here and on other sites that their mortgage lenders will defer for 90 days and then the entire amount is due all at once immediately at the end of the 90 day period. For self employed, entrepreneurs, small business owners, etc., who do not get unemployment benefits, this is a disaster.

@cate and others, of course we all hope you are wrong, but i am hoping that those small business owners who have paid taxes will qualify for the benefits they are talking about under the words “gig workers”. also, for small business owners who pay their taxes as an employee of say a corp or s corp and report earnings quarterly under a 941, they are, i believe, entitled to unemployment like every other employee. those us who report earnings as a 1099, we are the ones who have to hope they extend benefits to us.

this is one reason why it is important to pay taxes – it gives us the right to complain like everyone else.

of course, i am not an accountant, but there are things i have read over 20 years of self employment that have led me to believe certain things.

@cate and @bobjbkln I have have read that you can request forbearance on your mortgage and it will NOT affect your credit/be reported to credit agencies. I have also heard/read conflicting reports on how this will be treated- I have heard in some cases this will be due all at once, but it’s also possible that the loan can be re-cast and that amount rolled into the remaining principal.

This is possible for 3 months. I think the other item worth consider (again this can be helpful in the moment if you are having issues collecting rent, losing other income on your property) is who knows what legislation will be passed over the 3 months that may change the way this amount has to get paid back

@cate I called two of my lenders and the program they are offering is 3 month’s forebearance that will get tacked onto the end of the loans amortization schedule. Ie. if you have a 30 year loan, those 3 months of missed principal and interest will be tacked onto the end of the loan. The loan effectivley becomes a 30 year 3 month loan. HOWEVER, interest will accrue during those 3 upfront months.

Now a friend called his bank, they offered him 6 months of no payments and then after 6 months the entire amount is due.

So lenders are handling this somewhat differently.

@cate: most shops and restaurants are set up as corporations (to protect the owners personal assets if say some gets hurt on the premises). if the owners of these report their income and withholding with their quarterly 941 filing, then they should be covered by unemployment in NYS. i believe.

Agreed that policies seem to be dependent on bank. Mine (home, not for rental property) offers a blanket, automatic no credit reporting on late payments just till the end of May. After that you will get dinged. They also offer other options (smaller payments stretched out, delayed payments) but you must apply and prove that you have suffered hardship due to Covid-19 and await their decision. So a lost job might qualify but a slash in wages wouldn’t necessarily.

We briefly considered to do LLC for our house. For small landlords when you count each dollar and this is your primary residence as well the benefits of less interest on mortgage and tax deductions make more sense to keep property as a personal asset ( which is the largest personal asset). /so, loss of rental income is not covered by anything in this situation. If you do have loss of rental income insurance coverage – I highly doubt it would cover loss of rental income due to pandemic.

@olga, LLC’s can be set up as disregarded entities. Taxes flow through your personal return, and there is no differences or disadvantages in terms of taxes and savings.
