MTA subway entrance on property
I work for a contractor who does alot of work for the MTA and agree that this is typical for projects on or adjacent to their property. I assume when you say “Railroad Insurance”, you really mean Railroad Protective Liability. If that is the case, sometimes you can sometimes avoid needing the insurance, by proving that the workers have to exposure to train traffic, but this would be a high bar to clear as the MTA outside projects group is unlikely to grant an exception. One other potential work around to think about would be to use the NYC DOT Expedited Sidewalk Repair program, where the DOT repairs your sidewalk and then bills you. This might sidestep the entire issue.

I am looking for advice from someone who repaired a sidewalk that has an MTA subway entrance.
I got approval for the repair of my sidewalk from the MTA, but they are requiring my sidewalk contractor to carry “Railroad Insurance”. This is a great burden for me, Do all property-owners who have a subway entrance have this issue? Any advice?

I worked for NYC Transit a while ago and my recollection was that this is a requirement for all jobs that abut the subway system. I don’t think you can get your DOB/DOT permit until there is a full sign off from the MTA. You might make a hardship claim for a lower coverage limit. But when a contractor is working next to or above the system, the risk of damage is high and the MTA doesnt want to have to pay for potential repairs for which it wasn’t responsible.

Just consulted with our in-house civil engineer who works for transit (my husband) and he agrees with @bored. He oversees very large scale projects so he doesn’t have personal knowledge of this type of job, but says that transit often asks for extremely high levels of insurance/liability coverage from their contractors, so it wouldn’t surprise him in the least that they are asking for this.
