Eyesore in Prospect Heights Landmark District

Lots of complaints on the DOB website, mostly closed for lack of access. Maybe the last one, assigned to the DOB Emergency Response Team, won’t be closed too easily (or am I being naive?): http://a810-bisweb.nyc.gov/bisweb/OverviewForComplaintServlet?requestid=1&vlcompdetlkey=0001696456 Could the neighbors on either side sue, based on the house becoming a nuisance? “Under the common law, persons in possession of real property (land owners, lease holders etc.) are entitled to the quiet enjoyment of their lands…. If a neighbour interferes with that quiet enjoyment, either by creating smells, sounds, pollution or any other hazard that extends past the boundaries of the property, the affected party may make a claim in nuisance”.

The sign says it all. This building at 93 Saint Marks Avenue has been an eyesore for years now. A doctor from Indiana owns it. He bought it a few years ago and kicked out the tenants. It’s been vacant since then except for the occasional squatter. The building is rapidly deteriorating, as all the windows have been left open (or smashed by intruders) for the last few years and the gutters have fallen off. The place has been exposed to the elements for all that time, pipes have frozen and burst, and so on. The place is a wreck and looks structurally unsound. That could cause big problems for buildings on either side. The building is fire and safety hazard. It invites crime, squatters and drug dealers (before this owner, there was a big drug bust in this building). There have been complaints lodged with Buildings Dept., Sanitation Dept (for garbage strewn about in front, and rats) and Landmarks. So far no improvement. Any ideas? City officials? Anybody? It’s hard to believe the city allows this.
