I was issued a summons recently by the Dept of Sanitation. I have somehow managed to spend a lifetime in our fair city completely unaware that “…gutter areas (18 inches from the curb into the street) along the building perimeter must be kept clean.” Has anyone else been ticketed for this? Is it common knowledge that homeowners are supposed to literally sweep the street? Isn’t this what the mechanized street sweeping machines do during the alternate side ritual? Genuinely curious.

Common knowledge, but I don’t think this rule is very widely enforced on residential blocks. You just got (un)lucky.

Anymore details–was it especially dirty? Leaves or trash? Stuff in the street ends up against the curb and at any point some asshole parked there might dump a bunch of trash from their car into the street (the kinds of people who do this don’t seem to appreciate being told not to, btw). Even if you do try to keep it clean, you aren’t there 24/7 for that kind of stuff so how on earth can they actually ticket for it?

been getting lots of these where i work lately. in my experience they seem to like to pick on certain properties for a period of time so you might want to be extra conscientious for awhile. they can only issue violations from 8-9am and 6-7pm so you would be wise to do a quick sweep first thing in the morning and again in the late afternoon. also check the ticket to make sure it falls within the appropriate time ranges.

it’s common knowledge and widely enforced for larger multiple dwellings. i think enforcement officers let smaller buildings slide.

It’s just a two family, and the summons alleges both leaves and trash. Not sure how to prevent future tickets since I leave for work well before 8AM and return after 6PM. It’s a heavily trafficked street with a large public high school directly across from my property. I still would also like to understand why we pay for street sweeping services – four times per week on my block – and are still expected to manually clean 18″ into the gutter. Isn’t that why people have to move their cars?

I was similarly ticketed about 1 1/2 years ago. I took photos of the street in front of my house to show that the amount of “trash” by my curb and on my sidewalk was hardly excessive. I explained that I had cut my grass and swept up the sidewalk and curb area at approximately 2 that afternoon and that, upon returning late that afternoon after picking up a friend from the sidewalk, the space in front of my house was pretty much clear. I was given a hearing. The hearing officer asked me if there were a lot of students passing by my house, to and from school. I assented and, shortly thereafter, I received communication via post that the ticket had been dismissed.

squarepie – i work on the lower east side.
there should be a hearing date listed on the ticket so if you want to fight it you can attend the hearing. i think maybe the idea is that if you’re responsible for sweeping the sidewalk but not the gutter you’re likely to just sweep everything from the sidewalk into the gutter. that would be a lot for the street cleaners to handle in one pass every other day.

daveinbedstuy, I agree. I think the City has a data base of homeowners who haven’t been dunned yet. Then they nail you.

I have never heard of anybody being ticketed this way on our 100% residential block. I do know that this happens all the time on commercial streets. Frankly, unless alternate side is on, my curbside is parked solid with cars and it would be very difficult to clean.
