Building violation?
Thank you Maggie O. That’s super helpful. From our vantage point, it looks like a full story, and I had good look at the front today, and I can see that it’s recessed in front on that 5th floor, so I figured that must qualify it as a penthouse, but helpful to have the confirmation.

We have a fairly major construction going on across from us and I’m hoping someone with experience can help me understand what the permit allows them to do. They are building two stories plus another structure up tip- either a room and a roof deck, or maybe just a stairwell landing and roof deck. Anyway, permit says adding one story and penthouse. My big question is, what constitutes a penthouse? Is it just a top floor? Because this building is adding two full floors plus roof room.

I’d call 311. If what they’re doing is legitimate they’ll have no problem and, if there IS an extra story being built DOB can [hopefully] deal with it.

Penthouses and other rooftop structures (bulkheads, etc.) are limited to 1/3 the floor plate of the floor they sit on. See section 504.3 of the 2014 building code. As long as those structures stay under the 1/3 limit, they are not considered a “story.” This is typically important as a 4 story structure, plus a penthouse, does not need an elevator. While a 5 story structure does need an elevator. The ZD-1 form on DOB’s website should have a 3D diagram of the proposed work.
To see the ZD-1, type in the building’s address on DOB’s website, then click on ‘jobs/filings’ (lower left), then click on the filing for the Alt1. Click on ‘virtual job folder” (towards top/center of page), and finally, find the item listed as ‘zoning diagram’ and ‘ZD1’. That opens a pdf that you can download that will illustrate the approved bulk of the enlargement.

based one what you wrote and the permits posted i was able to find the zoning diagram for you. It looks like a full 4th story, a 1/3 penthouse, and then a bulkhead, which doesn’t count as part of the building envelope.
