Sigh, this city. When I first read about it I was like “surely there’s an exception for non-multi family properties” but alas I can’t find one. Seems to apply at ALL non-detached homes. Thankfully the hubby is an engineer but what is everyone else supposed to do? Someone tell me I’m wrong. Please.

Section 28-301.1.1 of the New York City Administrative Code was added by Local Law 126 of 2021, which went into effect on November 7, 2022, and requires building owners to have an annual parapet observation performed in accordance with DOB’s rules. This rule sets out the requirements for the observation and the resulting report. Specifically, the rule requires building owners to hire a qualified professional or another person capable of identifying hazards to inspect building parapets and identify any dangerous conditions. Upon finding an unsafe condition, the property owner must immediately install public protection, which must remain in place until the unsafe condit ion is corrected. The parapet observation requirement applies to all buildings fronting the right-of-way, regardless of height, except for detached 1- or 2-family homes.

I am not seeing the language you quote. I am seeing reference to inspections of parking structures every 5 years. The language in Section 28-301.1.1 of the New York City Administrative Code seems to apply to buildings over 6 stories. Maybe I am missing something?

Thanks Maggie, the second link provides what is required- thankfully they designate a handyman or super as sufficient but they need to write a report that has to be retained for five years I think. And still. . .

Thanks for additional links. No requirement the report be submitted. But perhaps would be relevant if there is a problem down to road or if the owner requests a permit? These seems like a mixture of common sense (check to make sure your building isn’t falling down) and shifting of liability to property owner. Where I guess it should lie. Seems like someone could create a checklist form for us normal people to use with our neighborhood handy folk.

it’s definitely common sense – “hey, building owner, look at that thing on your roof regularly and make sure it looks ok” but there are actual calculations involved in ensuring the parapet is plumb. it will be interesting to see how this all shakes out since this law is clearly encouraging folks to install sidewalk sheds when the mayor is trying to get folks to take them down…

I just read it through and it’s worth noting that they differentiate between a parapet and a cornice. Most rowhouses have cornices on the front facade, not parapets, so most non-multi-family homes are not affected by this. It’s also worth noting that in my experience most one- and two-family homes that do have parapets at the front are wood frame, so the parapets are less likely to collapse than a masonry parapet.

We have an actual masonry parapet as do many homes in my neighborhood and other large swaths of non-brownstone nyc – I know there’s a bunch of us who read the forum who are in old masonry homes outside the traditional brownstone areas. For those of us out in “flyover” Brooklyn (to those of you in “proper” brownstone neighborhoods), we’re stuck. Lol

You’re absolutely right that there should be other exceptions to the code, maybe based on the height, linear feet off frontage, distance of setback from the street line, etc.. This is a proposed change, so maybe there’s still time to submit comments.
