My neighbor shares part of my garden wall.  He’s on the avenue side and I’m on the street side, so it’s about 35% of one side of the garden.  He has been there much longer than me.  He has an old brick wall that is so obviously off line that if you dropped a plum line from it, it would almost hit the middle of my house.  In the photo, my wall is the cinder block one and his is the brick one, which is at about a 10 degree angle towards my house.   I put the cinder block wall because when I got the place, his back concrete patio was spilling into my garden.   I lined up everything geometrically and got his permission when I did that, back in 2008. Anyhow, he wants to build a fence using his brick wall as the marker.  I think it’s way off.  What do we need to do to establish the correct line, and who is responsible for paying for that?  (I’m okay with sharing the cost of a survey.)   How should I proceed? I also don’t want him to do anything until he has my permission. Thanks for your input.

You need a survey. In reality you should split the cost, but if you think it’s important and he doesn’t just suck it up and pay for it yourself. You’ll save yourself a lot of headaches in the future if you just make sure you have the documentation in the beginning.

If your wall is the cinder block wall, and you placed it and are satisfied that it properly is aligned with the lot line, then why can’t he just build his wall right against it?    I will say it is hard to see from that photo how his cement patio could possibly “spill over” into your garden.  Looks more like any spilling would be going the other way. But, since you already set up the correct line back in 2008 I would just tell him to use that line or suffer the possibility that his new wall will need to be removed down the road.

It’s hard to see from the photo, but his lot (the one on the left of the brick wall) is actually about 3 feet higher than mine–almost as high as my cinder block wall.  The plants on his side are where their used to be cement (that I paid to remove as it slid mudslide-style into my yard.  My patio is also cement. On a sad and irrelevant note, you can see the remnants of my pear tree cut up, victim of Sandy….

Is the brick wall on his side and if so, why does he need your permission to install a fence? It’s hard to believe this is even a dispute and you want to spend money for a survey. Does a few inches really matter?

First if there is actually three feet difference in height between the lots then the wall might be considered more than a fence.  Is it a retaining wall?  That would mean the person who owns the higher land is responsible for maintaining the wall at their cost.   the only true way to determine the exact placement is by an on site survey.  Boro Land Surveying  718 624 3500

You might have had a survey done when you bought the place – if you don’t have it in your posession the real estate attorney who represented you in the sale might – might be worth trying to dig that one up instead of paying several hundred dollars for a new one.
