Special Permit

You might find that there will be objections though. Under New York State law, you can’t obtain a liquor license for premises that are within 200 feet of a church, which is fine in a rural county but can be restrictive in NYC. So if your church wants to build near a commercial strip, the owners of the property on the commercial strip might object due to the 200 feet rule.

Is a Special Permit needed to build a freestanding church in a residential area in Brooklyn.  I was listening to the radio today and this issue came up. Apparently with a “Special Permit” there are certain steps that need to be done, e.g. public hearings for the neighborhood where the church is to be located, closer scrutiny of the structure, etc. I ask this because I’m presently living next to a church “structure” that’s been in development for over 20 years and there’s never been any attempt to reach out to the community in this way.  Any information would be appreciated. If the buildinmg is within the size allowed in the zoning district, nothing beyound a building permit is required.  You can look it up on the Building Dept website.

Churches would be Use Group 4 (house of worship), and are as of right permitted in all residential districts.  As argylerd said, no special permitting required.  It would be the same as any new residential building.
