Is it legal to Occupy with out final C of O?

C of O conversion from 3 family to 4 family . Interior renovations to remodel building. Plans approved, inspections just about done . Minor items needed for issuance of final C of O .  When is it legal to occupy the building? Is there something on Dob that would state that? How hard is it to obtain a temporary C of O?

When we bought our place it had something like 4 vacate orders going back to the mid 1960s. All of them had an exception that allowed a caretaker to live in the building (presumably to prevent vandalism, etc.) That means owners can live in their building as caretakers even if there’s a vacate order. Bottom line I doubt the City wants to be in the business of evicting homeowners from their homes (provided the homes aren’t completely unsafe). Now rentals are a completely different issue. Renting a unit that’s not in line with the current C of O (or temporary C of O) is very unwise. Both the owner and the real estate agent can get hauled into court and held accountable if the tenant challenges things.

If you have passed inspections and you really have only minor administerial items to be cleared up, then temp C of O shouldn’t be too difficult to get.  You have to renew it frequently though which just means more $$ and less pressure on the responsible parties to deal with getting the final C of O.
