We are renovating a brownstone. The heat has been turned off for the last month. Our neighbor has just come to us and said that we have to pay his heating because our building is sucking the heat from his. (they have been trying to get the thermostat working but the plumber hasn’t showed up). Do we legally have to do this? We already offered him a $200 inconvenience fee at the start of the project but he would not take it so we are not opposed to giving him some money but we want to know if we HAVE to do it.

Certainly is chutzpah. When you’re settled in and heating your home, using his logic you’re entitled to bill him for some of your heat that’s seeping through his walls. Of course he has a lower bill when you’re providing heat but I can’t understand how that’s an entitlement. Those of us with detached homes lose heat on all 4 sides.

So, based on his logic, if you demolished the building and decided to leave it as a vacant lot, you would owe him heating costs until construction. However, you set a bad precedent by offering him $200 for his inconvenience. Unfortunately, this is not the start of a good neighbor-to-neighbor relationship. You really have to weigh the cost of paying him off vs. the potential cost to the project from incessant calls to 311 for non-existent violations.

Is there by chance a renovation happening on the other side of this man’s house as well? I think you could give him the 200 dollars he refused earlier, and say that the money was meant for these sorts of things.

I miss old new york… the days when a person would hesitate before making such an asinine comment, because there was the real possibility of being punched in the face for it. The softer, kinder new york only allows the unrealistically nervy to get away with things that were kept in check years ago by mutual fear, lol. Either way, tell him he can use the 200 bucks you offered him to pay to fix his windows if he ever asks you anything like that again.
