Advice and Referral for Architect to assess site and reach out to Expeditor

Ick, I hate DOB inspections out of nowhere. I think you should reach out to an arch firm who also does expediting. I only work with larger guys in the city, but I’m sure there are some to reach out to in BK. I know James Cleary Architects posts here all the time- seems like a pretty knowledgeable architect. Maybe reach out to him.

So, I found a notice of violation from the NYC buildings attached to my front door. In it, they state CLASS 2 VIOLATION ” work without a permit work noted. At rear of premises extension to primary structure is created. One story masonry structure appear to be a garage approx 11 x 50 / access to noted structure is through basement area of adjacent properties on 20th street. new structure has roll down garage type door installed and curb type paved rear yard access.”

Remedy: “Make site safe, obtain permits and approvals if feasible or restore to prior legal condition”

Well, the garage was there from the minute we bought the house in 2011, so I think the complaint must come from the back neighboors in regards to replacing the chainlink fence and using their alleyway. This is the only work we have done to the backyard. We never got permits to replace the fence, because it is under 6 feet tall.
When we looked at our title, the garage has no Certificate of Occupancy, since it was built before 1938, and there is a 1937 tax assesment from a previous owner that states a brick shed is located in the back. Also, we have the listing of the house from 2010 that shows a photo of the garage, and states that parking is allowed in the alley.
Do we need to get architects to look at the site, and and expeditor? Any help would be appreciated, we only have until June 4th to come up with a solution.

Hi, an Architect is required. Expeditors are not licensed to perform professional services, they primarily drop-off/pickup documents at the Department of Buildings (DOB).   Your situation is unfortunate, but not uncommon. The previous home owner may have illegally built a garage, which you are now responsible for. You can leagalize the garage if it meets all applicable building codes, otherwise you may have to take it down. In order to determine if it can become legal, a number of things have to be reviewed. First is whether it is grandfathered. Next, does it exceed lot coverage limits, does it block light and air requirements, etc.   I have been through this process before.
