Cutting Into Interior Space

My hubby and I are doing major renovations to our apartment. One of the ideas we had was to put a balcony or small terrace on the back of the building. However, due to building codes we are unable to do that. The architect who we are working with suggested we cut into our interior space (about 304ft) for our outside balcony. My question is should we consider cutting into our interior space to do this. What would happen to the apartment directly below us (our outside balcony would be their interior space directly below) Are we asking for trouble by doing this? Any suggestions/thoughts/opinions would be greatly appreciated. Thanks!

I love this idea and have wanted to propose this but have not had the opportunity.  The architect definitely needs to waterproof and drained properly as debo said.  Sure there is risk for the apartment below, basically the same risk as living on the top floor of a building.

It could be interesting.  What kind of interior square footage would it leave you with?  What floor are you on?  Wouldn’t a roof deck work bettter?

I would guess the building would not allow it as it woudl be creating a wet over dry area and this one would be truly wet.  You might want to ask first before going through all the trouble of designing it.
