Need to know what should be the grilling and smoking policy in a brownstone with 4 units. I am working on drafting additional riders to specify pet policy, smoking and grill uses.
Can I demand no smoking policy in the whole building or at least in common areas? Can I also forbid grills in less than 10 feet from the building in the two units that share the building?

I have a tenant that broke her lease and moved out without leaving a forwarding address. She had given me a security deposit before she moved in, but since she did not give me proper notice (and also broke her lease,) I ended up losing rent until I was able to find a new tenant. I was finally able to find a new tenant who has moved in. The old tenant is demanding her deposit back and threatening to move back into her old apt. if I don’t give it to her, claiming she still has a lease for the apt. The amount of rent I lost is more than the amount of the deposit. technically she is the one who owes me money but I don’t want to go through the headache of trying to sue her so I was just going to let it go. Does she have any right to move back into her old apt??

I live in a 1 bedroom apartment on the second floor of a browntone. The house has 6 units like mine: two on every floor. I have a rent-controlled lease. My new landlord has started extensive renovations in the whole house. He claims he is renovating one of the floors, the first one, for himself and his wife to move in, whereas the 3 floor units are going to be rented out. He is renovating the entire 3 and 1st floor.

It’s not only the noise, but the dirt, and dust: the front door steps, the stairway, the walls, the It’s absolutely unbearable. All this dirt and dust is filtering into my apartment. there is dirt and dust all over my apartment: floor, furniture, clothes, everywhere. I came home last thursday and my apartment had a layer of dust, literally, i would just rub my finger on the floor and get it all black…I have even started coughing at night because of the dust. Just today somebody told me there might be asbestos in the house and I got terrified.

Can he do such renovations legally? Can a landlord renovate a house with tenants inside when the renovations are affecting the tenants so badly? What can I do?

I am the owner of a two unit building/row house. I live in the upstairs duplex and the tenant lives downstairs. We do not have access to the cellar due to the configuration of the rental….We have received notices from the gas company, as the electronic meter reading does not seem to be working. Our tenant has not allowed access/is not home – and not has provided permission for us to grant access (previous tenants did when needed with advance notice and this was never a problem). Note this is the first time we have requested access ever of this tenant and it is proving to be a problem. In addition we are doing renovations soon that will require cutting of the gas line for an hour or so (it is in everyone’s interest !) which will also require access to the cellar. What recourse is available to us ? We have already tried phone calls and emails and do not get a response. Note we have been on good terms, but granting access seems to be an issue. Thanks !

With this winter’s crazy weather, just last month, a leak appeared from our patio (which is also the roof of an extension) into our tenant’s apartment. I have been on the scene each time it has leaked (on two separate occasions over the last month), and I have been trying different things to repair, or at least fix the leak until the weather gets warmer. My tenant keeps mentioning a rent reduction or credit for the rooms that have the leak. What should I do?

I wanted to know if anyone had any insight regarding rent controlled apartments. I’m looking at a 3 family house that has a rent controlled apartment. What would be the quickest way (if any) to get that apartment de-regulated? I read that if that tenant leaves that it becomes rent stablized unless its 6 units or more? Any thoughts on that?

I inherited a set of tenants from the previous owner of a townhouse whose lease is up this summer. Recently, I discovered active sublet ads for the apartment online, some dating back to the first month of the lease. Since the ads were being updated daily, I immediately shut it down by confronting the tenants and their broker. My question is, would documentation of this facilitate a case for eviction, or not, since I caught them before they managed to rent it? Thanks Brownstoners–

the rent control tenants (since september) have been late with rent and then its not complete. So as of today they payed 1/2 the rent and the rest will not come till next week. I have been extremly understanding …sometimes things are hard. But this is now a convinience pattern especially since they just bought a huge plasma tv this week. Can I charge a late fee? or what can I do?

the rent control tenants have a bathroom with a light switch above the tub, There is no shower. It is the ground plan from the 1920 renovation. this is the way we inherited the building. tHE PAST LL tried to renovate the bathrooms but they refused because the rents would go up. What are my rights and obligations.

have a tenant that once again has created a lot of water damages. they knew that they were not suppose to use a home made utility. I just finished replacing the roof on the second floor from a leak under their bath tub. which cost 700 dollars to fix and re- plaster the ceiling. the time before they caused 2000 dollars worth of damages but I was unable to pin point the source of the water. They are rent control with no security deposit. what can i do? ive contacted our lawyer but have not heard back from him
