I would like to build an outdoor brick oven in my backyard, very similar to the one in the pic. I already asked the local firehouse and the captain said it was ok. However, not sure if there are any appropriate Building Codes for this. There are some construction codes that are appropriate that I see on the web, e.g., no wood if enclosing the oven. I was wondering, however, if there are any NYC-specific codes regulating this. The closest code I found referred to it as a standard outdoor barbeque. Anybody have experience with this or could point me in the right direction? Thx.

  1. See NYC Fire Code, Chapter 3, Definitions (open fire, open flame, open-flame device), starting on page 61, and especially (but not only) Section FC307, Open Fires, starting on page 65. (For example, also see page 71, 310.8 Hazardous environmental conditions): http://bit.ly/cOyXID

  2. I’d double check the firecode on it being wood-fired. I know that chimineas and clay fire pots are not allowed (being considered an “open fire” per FDNY rules. I learned this the hardway, having the fired dept come and hose out a fire in my fire pot last summer. It’ll really end up being a matter of whether you have any neighbors that are bothered by the smoke, and whether they call 311 about it. Even if the local firehouse says it’s okay, it still may be problematic. However, if you run it with charcoal and the charcoal is kept behind a metal door with vents, you may be able to meet fire code. Also be sure to use a spark arrester to prevent embers escaping the chimney. And post an update if you find anything out? I’d love to build one of these as well if I knew I could get away with it.

  3. Wood-fired oven. Back yard is about 20×20 space. Closest building is my detached garaged. Closest residential building is the neighbor across about 10′ away from my property line. No other structures around. I’ll be creating the appropriate concrete foundation. All other materials will be brick/block. Chimney will be appropriate rated aluminum chimney. Thx.
