    1. Yes — Roe and its progeny constitutionalizes the right (i.e. the decision to have) an abortion, but does not create a right to funding.

    2. jackal — I think there is an important distinction to make between saying a decision was wrongly decided and saying that there is no right where teh S.Ct. said otherwise. I will always take issue with decisions I think are wrong, like FEC for example. But, as a legal matter, corporations are now persons for various purposes under First Amendment. They have been found to have constitutional rights. My point is, when someone says: “When someone posts that it’s a constitutional right, they better be able to read me the line saying so” I am going to point out that, under Marbuty, that’s wrong. He’s challenging the existence of the right based solely on text, not experssing an opinion on the wrongness of Roe.

    But pulling the Pres, into it is a red herring. He was pressured to put that order into the bill in order to get it passed. THere were enough anti-abortion democrats around that he had to do it for the greater good of getting the bill passed, because these one issue people would kill the whole entire bill because of it. Which is like starving, then turning away from a five course meal because you don’t like peas. I don’t get it.

    Roe v Wade gives a woman the right to an abortion. Plain and simple. Which means it is not a crime to either have one, or perform one, under the circumstances provided by other laws. It does not mandate who pays for it, so you are playing with semantics.

  3. Supreme Court totally made up the abortion right. Plain and simple.

    But like I said, they basically get to do that as long as they can make a not completely embarrassing argument for how they think it is actually provided for in the constitution. If it passes the laugh test (which Roe v Wade kind of sort of does) then hell, they’re the Supreme Court, what they say goes.

    Just as long as the libs doesn’t bitch and moan when a conservative Supreme Court decides to do the same with the second amendment. Like I said, what’s good for the goose is good for the gander.

  5. dona-TEL-la, very sorry to hear it. Yes, by all means, think about the start of baseball season. I always look forward to pitchers & catchers reporting. And my sister always likes to remind me that Jeter usually reports ahead of everyone else.
