I would go further and say that, in addition to med-mal award caps, offer an administrative claims matrix alternative to litigation. Forego litigation, get a smaller payment, but receive some real compensation for medical expenses and ongoing out of pocket costs, and perhaps a small extra amount akin to “pain and suffering”, but far less than you might get in litigation.
