I get that. But what is the law exactly? And are the laws different based on your zoning? That’s what I’m trying to have answered here. Just because the police turn a blind eye, doesn’t necessarily mean they are within the law. It could just be the offense is to too low level. I get that and I can even accept that. But given that most of the complaints you can file via 311 are for illegal offenses (blocked streets and sidewalks is one), I would think there is a reason to have it there to begin with. Also, does anyone know if there are rules for the size and frequency of deliveries based on the size of your business footprint/warehouse?

Need some tips here. I live in Gowanus on a mixed residential/commercial street (M2-1 Zone). Across the street there is a business which uses the street as a make-shift loading dock by leaving pallets of paper and office supplies on the street for hours…sometimes the width of two cars. They also leave them on the sidewalk, but leave a very narrow alley for pedestrians to walk through. Really this wouldn’t be a big deal, but the mess outside and the semi-trucks that attempt to unload cause traffic jams and lots of honking. Not to mention, some of the pallets have goods that reach 10 feet in the air and I worry it’s a safety hazard. They also operate a fork lift that whips up and down the sidewalk, through neighboring property and into the street. It is very hard to make complaints that go anywhere (maybe it’s not illegal I don’t know). They have two signs (which appear to be filed through the DOT) that designate the spot in front of their building for trucks unloading/loading. However, it’s not actually used for this purpose and instead it is being used to keep the spot free to continue using the street as their loading dock. Is there a way to challenge their signs, or have them reviewed? Or maybe a better channel for making complaints other than 311. It’s becoming quite a nuisance as they begin at 5 AM and end around 7 pm. We have spoken to the business multiple times but they more or less laugh us off.

I don’t want to belittle your problems and the lack of response from your commercial neighbors, but M2-1 is not a mixed residential/commercial zone. Even if there are pre-existing residential buildings, the M2-1 is a moderate industrial zone. If you choose to live there, you need to accept the consequences of living in a manufacturing zone. Yes, I am well aware what M2-1 means and accept many of the consequences as long as they are within the law. I was simply stating the street is residential/commercial. My question is whether it is legal to use a public sidewalk and street as a loading dock. We have many commercial neighbors who we enjoy living side-by-side with. In fact many of them have similar issues with the same company/building.

The whole area on 2nd avenue between 12th and 14th street can be a nightmare. There are two businesses and the sanitation department and they all routinely block the sidewalk by using it as a loading dock, or for parking. At night when you’re forced to walk into the street, it’s pretty dangerous due to a lack of lighting and potholes etc.

I attempted to open something with 311\. It was closed by the police department within a couple minutes with this “The Police Department responded to the complaint and determined that police action was not necessary.” What’s odd, 311 has a place to submit complaints for blocked sidewalks/streets, but I guess it’s too low level for the police to care.

I have to agree with bobjbkln. By choosing to live in a commercial area you have to assume the nuisances that come with it. Judging by the response of the police and 311, the business is operating within the law. Now you need to decide if you can live with it or need to move to a different area. Seems to me that the business in question is doing what they need to do to function. Good thing too, because this city needs businesses like this to provide jobs and tax money to keep the city functioning.
