Change Orders/Credits
We had a bunch of change orders on our recent renovation and I was wondering whose responsibility it is to make sure that credits in our favor are reconciled?

Thanks masterbuilder, that is exactly the type of answer I was looking for. We will do a third and final phase of our renovation next year and I want to start making of list of ways to improve the process going forward.

If your architect is helping you overall with requisitions (I use the standard AIA forms for payment) then I would expect they would monitor debits and credits through a change order process. Ask them to prepare a list of possible credits and submit it to the contractor. You could also submit such a list to your contractor. By the way, I write credits directly into my change orders. Sometimes there is a change in scope that does not require a change in cost, and I also write these up.

I’ll clarify my question. We are using capable licensed contractor and architect. We’ve had many change orders for additional work that we have signed off on. There have also been changes to the scope of work that are in our favor–we opted not to have double sinks in the new bathrooms. Therefore we are due credits for work not completed. Is it normally part of the architect’s job (if they are overseeing the whole project) to make sure that “credit” orders are reconciled? I’m asking for future reference.

Go to the NYC Dept of Consumer Affairs website and you will see how we licensed contractors are required to use contracts and change orders as a term or our licenses. This is a good example of why a home owner would do well to hire a licensed contractor. Home owners are not required to hire licensed ones, only the contractors are required to be licensed, and this sets up an imbalance. A contract or a change order should be an agreement where both parties are required to follow the law and the terms of the agreement. As a home owner, you can only achieve this with a licensed HIC. As consumer-protective contractors, we can not compete fairly, if the DCA has only managed to license some of us. If you changed your plan to install something, and that item is not refunded to you, ask your contractor about it, and work it out together before you sign your CO. Perhaps some preparation to install it was already performed, or restocking fees apply. It is both of your responsibility to discuss it and full documentation from the start is helpful in defining expectations.
