Condo Board of Managers not enforning the laws on construction

I live in a condo in Brooklyn, 3 other units have done constructions with out board approval(proposal/vote). The board new about it, just did not want to deal with it. We are doing construction on the same common elememnt as our downstairs neighbor did last year- they did not obtain approval. In new york state is this defined as selective enforcement, can they not enforce the law (like in other states) because it was not applied in past situations? I can’t find this info for NY state
